I believe I saw something that said Metcalf broke Anthony’s phone in the days prior, which was why Anthony was under the other school’s tent. I also saw someone say that technically Metcalf thew the first punch.

If the defense can convince the jury that this is true, then the prosecution can forget about 1st degree.

It will be viewed as a negligent or reckless action. Probably 2nd degree / involuntary manslaughter, something like that.

In the 70's you set your tarp up on the field. You had your area on the field and your music playing from your teams' boom box. No athletes went into the stands. Why would anyone want to go sit on concrete after running?

"Involuntary" does not mean "accidental".

It will come down to the ability of the defense to convince a jury that the killing was not premeditated.

I predicted in a different thread. Anthony will either plead down to a lesser charge, or the jury will convict him of a lesser charge.

He won't be convicted of 1st degree murder.

This tent in the stands thing they do at track meets these days is dumb. That's my biggest takeaway from this story.

The black team was actually on the side of the victim but the other teams on social media (twitter/facebook) decided to constantly bash the other side with their insults. It’s been nothing but constant talk of blacks not having impulse control, constantly being called monkeys/****. The kid had a DEI GPA. So yes people get tired of reading the bullshite and tend to lean towards their own race. You can discuss the case without throwing out your jokes and insults.

It is not my job to think for you. Think about it without emotion. Your emotion is leading you down the wrong path.

BTW, one of my sons is a Republican DA in Kansas, so I have been given some professional insight into possible outcomes. Kansas and Texas law is not exactly the same, but close enough.

Bringing a weapon to a school was certainly voluntary.

I can assure you jurors in this county will not look past that fact when issuing a verdict in this case.

Each school/team sets up their own covered area using their school branded tarp set up on bleachers for various functions including storing personal items and getting out of the sun. Anthony’s school had their own area set up which is where he should have been or in a common walkway coming from or going to the track field. It’s probably not uncommon while walking by to talk with students from other schools and maybe even take a quick selfie if they still allow phones, but it’s much less common to treat area like it’s your own school’s when it’s not. If asked to leave you do so as it not your area to hang out at (you also never go there by yourself with no members of the other team present due to all their personal stuff in area specifically because it’s not your area).

The one time I went it seemed like coaches or other staff would every now and then check the stands and remind the kids to stay in their own area.
