Question about auto accident and insurance.

My son was in an auto accident and the other driver was at fault. He is going to be alright and is doing well.
He is going to have a minor surgery and my health insurance is paying for it. The other drivers insurance told me to keep up with my out of pocket expenses and they will reimburse me. It seems to me they should also reimburse my health insurance company for their share of the surgery. No one has mentioned anything about that.

His liability insurance will have a certain amount of bodily injury/medical coverage if he's found at fault I believe.

I know this sounds cliche, but I feel like this is a time where contacting a lawyer is not a bad move.

Your health carrier will send a subrogation lien for any money they pay out.

Your health insurance company will likely "subrogate" against the other driver's insurance. Basically your health insurance will pay up front then go after the other driver's insurance to recoup as much of their expenses as possible. Happens all the time in auto accident claims

And OP, they do owe the insurance company as well, but it sounds like they'd rather pay your out of pocket stuff to you first.

Yes the surgery is a direct result of the accident.
I contacted my auto insurance but really didn't think about telling my health ins. company. Never really heard of a health insurance company going after an auto insurance company for payment.

If they pay for something that's accident related, they'll definitely want their money back. In some cases they may waive subrogation depending on what the at fault persons limits are so you can have recover as much as possible.
ETA I would think the other person carries decent limits if the adjuster hasn't said anything about any limits issues. That's a good thing.

make sure you get paid for pain and suffering. Could help pay for his college and be a down payment on his first house.

What kind of surgery? You get full costs of medicals from the other insurer. Your health insurer will want reimbursement from you. You can negotiate that down. Don't know about Alabama but in Louisiana your health insurerer doesn't get paid until you're made whole, including pain and suffering.
You should be getting a lawyer. If you don't they WILL screw you.
