Possible legal trouble for sending texts to distracted drivers

I guess in some cases they could prove u knew they were driving. Crazy

They aren't obligated to read or respond to the text. That's on the driver. What about the radio? Can we sue the radio station for playing nickel back and causing us to fiddle with the tuner?

That's pretty weird. I mean, I purposely don't text people when I know they're driving, but I'd hardly say it was my fault if they happened to be.
That said, I am so tired of looking around at a red light and seeing every single person around me texting.

I really don't understand why cops aren't cracking down on that. They could pay for their entire department in a day.

Yep. All you have to do is look at the cars turning left as they pass you, and half of them are texting mid-turn. I can't tell you how many times a week I miss traffic light cycles that I should have made because someone in front of the line didn't look up from their phone quickly enough.
I saw someone a couple days ago who was so into their phone that they missed an entire green light. When they finally looked up, it was yellow so they went, and the person behind them missed the whole thing.

Because teens will get their parents to fight it, or an older woman will call it harassment. Because they never do any wrong. The cops are just out to get them because cops are bad

Because it's a PITA, they don't know how to prove it, and the fines aren't enough for it to be worth their time. They do not care about texting and driving unless they are trying to pull over a suspicious vehicle or are trying to get someone for a DWI. Just line the seatbelt law, and just like the left lane law

Yeah. I've never had this issue because I lay on my horn for a good bit. Just so they get the message.

in reality this is ridiculous
thats like holding a bartender responsible for giving a guy the beer that puts him just over the legal limit
or holding mcdonalds responsible for giving a guy food at a drive through thats distracts him because he's eating while driving
or holding a female passenger responsible for giving you road head which distracts you while driving

I do as well. Even when someone is just driving horribly. If the person in front of me is swerving into the oncoming lane several times and it is obvious they're texting, I'll even lay on my horn for that

I do not live anywhere near campus. Maybe you just don't look at people in their cars? I started creeping on them when Jones pointed out one day when he was my passenger that everyone around us was texting.

That's a reach. Those "special circumstances" have to be tough to overcome as it relates to a plaintiff trying to add a 3rd party texter.

Text messages were designed to discretely send a short message to someone with no anticipation of when it is supposed to be responded to.
It has become a way to hold a conversation with someone you don't really want to speak to.
