In MS it wouldn't matter in reality, as our negligent homicide statute refers to the manslaughter min/max for sentencing. This would most definitely be indicted at minimum negligent homicide here, but more thank likely indicted as manslaughter, then plead down to negligent.

Multiple counts of indictment. A jury might not convict on 1st degree, but might convict on 2nd degree. They are different crimes. So you can be prosecuted for all. I'm sure a lawyer can explain better.

You’re describing a responsive verdict. DA could charge with murder and perhaps the jury comes back with a lesser responsive verdict such as manslaughter or negligent homicide.

But I swear I’ve never heard of three separate homicide charges for one death. I guess manslaughter and negligence must have the same elements in New York. But it was one act which caused one death. Seems off.

Dementia is often associated with violence. I don't know what happened in this case but objectively an old person with dementia can be very aggressive.

Pushing an 86 year old to the ground is assault and should be treated as such. If the victim dies, then a manslaughter charge is warranted.

I would bet a substantial amount of money that this case does not resolve with a conviction of Manslaughter in the First Degree. If I picked up this case in Louisiana right now, I would be utterly embarrassed if I couldn't work this down to Negligent Homicide at the absolute worst. I would be aiming for better than that.

What’s silly is thinking you need to sling an 86 yr old woman over a virus that you have a 99 percent chance of surviving.
