Suing a big pile of money(an insurance company) is waaaaaaay easier and more profitable than paying at least two lawyers their hourly rate for several years to litigate a property dispute.

A lot more people get in car accidents than buy historic properties and end up in commercial land disputes.

Ha ha! Good luck. You’re going to waste your time. If it’s been on there for several years and I imagine it has, and nobody said anything, it’s theirs now. Not shite you can do about it.

You don’t need a lawyer for this because they won’t know. They’ll have to look it up in their shiny law books. Grok can explain it to you like you’re 5, or like I just did. What’s it with you people and lawyers? Jesus man!

If I was going to be an attorney, I would just do divorce law. Best way to feed your family and pay the bills. Sadly it brings out the worst in human nature so you trade your should for wealth.

why would you not sell or lease to them what you arent using and they are? IMO that makes more sense than being tied in with them... not to mention if someone gets hurt on "their" portion of your property. do you really want to get lawyers ivolved again down the road when you ask them to repair this alley and they dont or do a shitty job?

Yes, you need an attorney. Bring it to his attorney.

I can't speak for MS, but the general practice in Louisiana if there are conflicting survey's is to hire a 3rd surveyor and see who's matches up.

True, but the fact he has mentioned he had a survey done and never produced it months ago makes us all think he is lying.

I wonder this as well?

As a lease, you add income value to your property while you own it and add more value when you sell. You could do something like a triple net lease and have them carry the insurance for that property at their expense while you do a sub policy on your own and add some coverage to the umbrella you carry for your property.

Seems a win - win for all but you have not hobbled a future sale of your property.

On a side note, if they are commercial, and you are residential, if you need to up zone your property to commercial, this piece of land (yours) may grandfather you into your up zone and greatly reduce your cost to up zone.

How it is being described to me is where the parking lot extends to is not my land but my half of the shared alleyway that is owned by the city. We can either agree to share this or I can force him to remove it completely.

What does your survey say?

If the city owns part, that will not be in your survey?

If the city owns it, and grants an easement to both of you, that is not in your narrative so far. Quite the opposite.
