How could anyone think Stewart would intentionally kill a guy. Yes he has to live with it but it was a horrible accident.
If you listen to the audio of the video and look at the speed of the other cars passing Kevin, it is pretty clear that the Yellow was out.
You can also clearly hear an acceleration right as Tony's car was next to Kevin.
I don't think Tony intentionally killed Kevin.

From the video I saw it looked like the other guy got out of his car and got infront of Stewart. Just seconds before he was hit he had to dodge another car. I don't know what Stewart did prior to entering the frame but the other guy..Darwin got him.

I'm trying to remember any driver literally running that close to a moving race car.
Plenty of helmet-throws and fistfights after the car stopped, but I just can't recall a guy getting that close to car on the track.

YES! But the camera and therefore the microphone werren't near the accident, they were elsewhere on the track.
It's like hearing a person scream during a football highlite filmed from the stands, do you think the scream is from the tackler? NO It's from someone right next to the camera.
IMO the acceleration noise was from a closer car to the camera. It's WAY WAY too audible.

I certainly can't stop people from joining in on this discussion but the ones with no racing experience are blatantly obvious.

How about this then; stay in the freaking car until the safety crew reaches you or unless you feel your life is in danger.
They need to fine the frick out of anyone that gets out of their car for any other reason.

hold on. Explain this one. How many bumps like this are there in racing? How many of those involve the wrecked driver getting out of his car at the top of the live track and walk into traffic to make a scene?
No one on earth could have "easily anticipated" him doing that.

Even with that though, Tony doesn't run right up to the car, he throws the helmet.
(He does get some of Kenny when Kenny gets stopped)
To think a guy would run up to an open-wheel car is kind of stretching it, IMO.

Should we also assume that you are also somewhat familiar with the personality of Tony Stewart?
If so, would you find it out of character for Mr. Stewart to see how close he could get to a driver trying to show him up at a podunk little dirt track? Maybe even bump out of the way, or throw some dirt on him?
Or would you find that highly unusual for Mr. Stewart's personality?

This is how I see it as well. I don't think he will do any sort of jail time at all, but it is my opinion that he sort of tried to buzz the tower at that kid and accidentally hit him. I know the kid was certainly an idiot for getting out and walking in harm's way, but you can't make me believe that Tony Stewart didn't see the kid.
What sucks the most is that the idiot cameraman follows the wrong car when he should've been focused on TS's car since obviously that was the one the kid was going after. Had he done that, we'd have a much better picture of what happened.

Not at all. But if that was his intention that would have been what would have happened. Not this dude getting under his rear tire.
