OT Lawyers: Are bands liable for breach of contract if they cancel shows...

Not a lawyer but it seems like it would be a good idea to have a cancellation clause.

Most band contracts with venues have clauses to allow for bands or venues to back out in given circumstances without penalty, and establishes stipulated damages for backing out absent those circumstances. Each contract is unique, however.

Odds are, the band's pullout was either a permitted circumstance or they already payed their penalty.

Obviously it's been stated already, but it's all about what the contract says. A lot of times, cancellation clauses are built in. A good bit of those clauses allow for cancellation up until a certain point and lay out damages if they cancel after that time.

Thanks. That addresses one of the reasons that I asked this in the first place. We were having a discussion at work about Pearl Jam cancelling their NC show tonight and I wondered if the band doing it so close to showtime was a potential issue.

I would think that cancelling it on such short notice and no emergency situation would mean that they are paying some pretty big money in damages to the promoter and venue.

If your question is whether they are liable to the venue for breach, then it depends on the contract provisions.

If your question is whether they are liable to you, as a ticket holder, you should totally sue, man. It's like a slam dunk tortious breach of a social contract, man. The art belongs to the people, man.
