OT Lawyers - The free U2 music on iphones

I was wondering since I didn't agree to this and it was given to me for free, I could use it anyway I see fit, i.e. commercial use?

Plus, could Apple be sued for putting this on mt phone with out my consent?

This is just small talk, bored on a Tuesday evening

I'm sure they covered that in the 100 page agreement we just say yes to and never read.

no

You have the right to listen to it via a license. Not distribute it or use it in any other way.

It's the same as if someone makes and hands out a free album to promote something. It's their intellectual property. You don't 'own' it. You purchase or are given the right to use it in a specific manner.

You were only given the right to possess the tracks for private use for free. U2 and the distributor still own the commercial rights to it. The exact same as if you were paying for it.

Yes. I am sure a multi billion dollar company didn't run this by any number of the high powered, highly payed attornies the employ to make sure it was covered under the ToS thus leaving them open to a huge class action.

I know you are just making small talk. But ask yourself this question...What are the damages? What would you be suing for?

no, I'm sure it's on the contract you agreed to via a user agreement consent.

It's also, From my understand, not actually on your phone. You still have to click and download it via your cloud. So, I highly doubt you would be successful and most wouldn't have the money to pay a team of attorneys to keep up with Apple's motions and discovery bs. It would be a nightmare.

It would have to be some consumer advocacy group footing the bill.

So, even if you could sue them, you couldn't sue them.
