Filing an injury claim is not suing someone, so don't feel bad about it.
ETA Even if you are attorney represented.

My wife was involved in an accident recently. Someone pulled out in front of her and she hit the side of their car. She has a witness that will corroborate her account of the incident. Both my wife and the other driver suffered minor injuries that did not require serious medical treatment. She went to the doctor the day of the wreck and got X-rays, but lingering pains have been popping up since the wreck. The main issue I am concerned about is her neck. We just bought her car 4 months ago, and have GAP insurance, but I am not sure if the amount she will receive for the repairs will be enough if her vehicle is totaled. My question is, should we hire an attorney, or is the cost required for legal council not worth the time or possible outcome? I've told her to go back to the doctor to document her recent pains. For the record, we aren't those type of people who like to sue just because, but I also don't want to get screwed for something that was not my wife's fault. What should we do?
Oh, and no pics of my wife.
TIA.
I had a minor injury with a car accident a few years ago. The property settlement was done first. If car is totaled, they will not send you money for repairs. They buy the car and your GAP insurance covers the difference.
The personal injury was done after I recovered. If major injury, you may want to talk to an attorney but I didn't need to in my case. They threw $17k at me on top of my medical bills.

Instead the bills could have been paid by their health insurance or medical payments coverage if the auto insurance provided this coverage.
Keep in mind that your personal health insurance company can ask for their portion back after settlement.

Most of them will hear this same story for free and let you know if they want to take your case or not.
Hell, I'm sure some have forms you can paste your OP in on their websites and they'll email or call you back.
Definitely worth talking to an attorney.

We have insurance, both full coverage, and GAP insurance, but I don't think we should be penalized if it's not our fault

Thanks for all the advice.

There are so many things incorrect in your two posts I do not even know where to start. You are telling the OP to do exactly what an insurance company hopes he will do. Not get a lawyer. Get screwed with after market parts on the repair. Not get the medical treatment from a Board Certified specialist and then have to pay deductible on a surgery on wife's neck 4 years from now because she cannot take it any more. Also, I do not know a single lawyer who takes a fee on property damage. If one does, they should be disbarred.

Attorney gives no fricks about your car. He wants to see the value in your claim. Typically you can get 1,500 to 2,000 per month on a soft tissue injury. You can resolve this claim for you wife without an attorney easily.
So has liability been determined by the other carrier yet? I've seen where the wife is scared to death by her husband and lies about the accident. I've seen it a lot in depositions when it's under oath. Not say she's lying.

Go to the doctor and get a record of ailments.
Complain of severe neck and head pain.
Lawyer up.
???
Six-figure settlement.

Yes, but that is irrelevant to the claimant. She got her treatment paid in whole or in part by the health insurer and /or medical payments coverage under the auto policy. The ultimate payer would be entitled to subrogate for their payments.
