Filing an injury claim is not suing someone, so don't feel bad about it.

ETA Even if you are attorney represented.

I had a minor injury with a car accident a few years ago. The property settlement was done first. If car is totaled, they will not send you money for repairs. They buy the car and your GAP insurance covers the difference.

The personal injury was done after I recovered. If major injury, you may want to talk to an attorney but I didn't need to in my case. They threw $17k at me on top of my medical bills.

Keep in mind that your personal health insurance company can ask for their portion back after settlement.

Most of them will hear this same story for free and let you know if they want to take your case or not.

Hell, I'm sure some have forms you can paste your OP in on their websites and they'll email or call you back.

Definitely worth talking to an attorney.

We have insurance, both full coverage, and GAP insurance, but I don't think we should be penalized if it's not our fault

There are so many things incorrect in your two posts I do not even know where to start. You are telling the OP to do exactly what an insurance company hopes he will do. Not get a lawyer. Get screwed with after market parts on the repair. Not get the medical treatment from a Board Certified specialist and then have to pay deductible on a surgery on wife's neck 4 years from now because she cannot take it any more. Also, I do not know a single lawyer who takes a fee on property damage. If one does, they should be disbarred.

Attorney gives no fricks about your car. He wants to see the value in your claim. Typically you can get 1,500 to 2,000 per month on a soft tissue injury. You can resolve this claim for you wife without an attorney easily.

So has liability been determined by the other carrier yet? I've seen where the wife is scared to death by her husband and lies about the accident. I've seen it a lot in depositions when it's under oath. Not say she's lying.

Yes, but that is irrelevant to the claimant. She got her treatment paid in whole or in part by the health insurer and /or medical payments coverage under the auto policy. The ultimate payer would be entitled to subrogate for their payments.
