The comments in the local article are most unkind to the "spank" apparently she instigated the the entire incident and then called her ex and his biker buddies to intimidate her boyfriend.

He knocked the other guy out with the hammer, picked up the gun and murdered him, then hit himself in the head a couple of times to create that story

That is much more plausible than clearing a gun while being beat on the head with a hammer

I did a Google search using the defendants name. I found several articles all describing the fight in the same way as was described in the link I put in the OP. However, I've not found a link to the video. But having said that, if the video had shown something different than what the news reports described, I'm quite certain by now this would have come to light.

Older bikes sometimes have a tenancy for the starter to get stuck. When this happens, a couple of light taps from a ball peen usually will make it stop. Old shovel heads were notorious for it. This is why a lot of bikers started carrying a ball peen hammer with them. Of course it was not hard for them to realize it also made a handy weapon as well.

No it's not. I've had countless nights out at bars and thankfully have never had anything like this happen to me. But what does that have to do with this guy deciding to pull a gun and try to kill this other guy?

In all my years I've only seen a ball peen come out once. What it did was ugly.

Holy shite.

The one I saw was just one blow. Not sure what even started it. Just heard a commotion not far from us. I looked over just in time to see a guy pull a ball peen hammer out and lay another guy out with one swing to the side of face right next to his ear. It had nothing to do with us so we didn't stick around to find out what happened next.

There should be no question as to what happened. Either he was threatened with a gun first or he wasn't, and if was caught on camera then it's pretty cut and dry.

If this is really how it played out with it being caught on camera and finding the unfired bullet on the scene further justifying having to rack the gun for a FTF, then this judge is a piece of shite and is the reason why are justice system is such a fricking scam.

I blame the DA more so than the judge. In fact, I'd say the judge made the right call in dismissing the charges. As for refiling the charges, is that up to the judge or the DA? I'm thinking that's up to the DA but I could be wrong.

Seriously.

The hazing you received for telling the story of the guy being hit in the jaw was likely worse than the hit itself.
