Notice of delinquent debt from Louisiana OMV from 13 years ago

I received a notice form the Louisiana office of motor vehicles saying i had a lapse in insurance on a previously owned car from 2002. They just sent the notice this week saying I owe a few hundred bucks in "delinquent debt" and need to show proof of current insurance or that I disposed of the vehicle.

I've never had a lapse in insurance and i'm assuming the notice was initially triggered when I transferred title to Texas after moving here and also got off of my parents' insurance onto my own policy. Why it has been sent to me (my parents address in Louisiana actually) this far down the road is beyond me.

It would be an absolute pain to go dig up records from that long ago to prove that there was never a lapse and that I sold the vehicle. Any advice on how to handle it? I know i've read in other posts that it's better to not acknowledge an old debt claim when it's this old, but wanted to see if anyone had specific advice since it's a government agency. Thanks!

I would email the OMV and tell them to go fly a fricking kite. There are statue of limitations for felony crimes don't even go back that far!!

First, I would confirm it is indeed the Louisiana OMV that sent the letter. People joke about how inept government entities are, but 13+ years is a long time to wait over a couple hundred. Also, I'm assuming there would be some sort of interest if it is a true debt.

I just got the same thing for a motorcycle I cancelled insurance on because it no longer runs.

Yeah, it has a schedule of the fee increasing over time and capping out. It's unclear if their schedule starts from 2002 or from the date of notice which was earlier this week. Either way, I just don't want to deal with finding records and I'm not going to just hand over a couple hundred bucks to make it go away.

On top of that, it was sent to an address that is no longer current so they have no proof that I ever received it. I guess they could track this post...

Exact same thing just happened to me this week. Received a notice that I was delinquent on 2 cars and that I owed $1000 a $1300.

I moved to Texas 4 years ago and transferred my cars to the state as well. Turned in my Louisiana plates when I left at that time. I didn't keep the records because I never thought it was a big deal.

The state mailed my letter to my parents house, which I haven't lived in for over 15 years.

What aggravates me is that they will escalate collections to a wage garnishment level of I don't pay.

From a person who has paid off over $2000 in OMV holds in my life. I'll tell you this, you will not be able to renew a vehicle or get a license with this hold.
I had the opposite of yours, a Texas hold made it to where I couldn't get a license renewed, so I just drove without a license. Finally paid that off. Then years later two cars I sold after Katrina (with the plates on them came back in the form of twin $525 flags on my licence. There used to be a cap of $500, now it's $900. So that was another $900.

These things will follow you forever.

I got one of those years ago. DMV screwed up the VIN on the vehicle in question. Contacted my insurance company and they sent me a document that showed proof of coverage and mailed it back to the state. About a year later they sent another notice for the exact same thing and I sent another copy of the document and highlighted the part that shows their mistake in the records. About 6 months later I go in to register another vehicle and that same issue pops up again. I go home, get the insurance document, and have them fix it in person. LA DMV is run and staffed by retards.

This happened to us as well and the insurance keeps trying to correct it and it still hasn't corrected with the dmv. Seriously Louisiana is the worst when it comes to this shite.

I received two of these "cancellation... lapse" in insurance things for two different vehicles. It's just down right ridiculous how nit picky this state is when it comes to laws. Don't get me wrong, I like Louisiana.. I just cannot stand the laws here compared to other states.

One vehicle I received it for was a vehicle I had sold. I cancelled the insurance when it broke down and was no longer usable.. so I listed it for sale. I sold it 11 days after I cancelled the insurance and even filed a change of ownership with the DMV/OMV. Well the letter I got states you aren't penalized if you sell the vehicle within 10 days of the cancellation.. I sold it in 11 days. 1 day past their grace period or whatever.

Any ways, it said I could still clear without a fine by turning in my tag within 10 days of receiving the letter/notice in the mail.. So we did that and they cleared it off our record and even let us keep the tag (it was a custom tag we bought)

The 2nd cancellation we received was for a vehicle that was also broke down but we were having fixed and when I spoke to my insurance company about what I could possibly do they suggested something called "in storage" So I said okay.. so it basically doesn't charge me for the duration I was going to have the vehicle repaired.. but it doesn't fully remove the vehicle from my policy. It was my understanding from them that this was not a cancellation.. and I could put the vehicle back on the insurance any time.. Well we had the vehicle fixed faster than anticipated so I called in to have the vehicle taken out of "storage" within only 1 week..

Several months later I now receive this notice of lapse\cancel in insurance.. because of that..

The thing is you have to have insurance on all vehicles you own or are registered, even if they do not operate, unless you file online through https://omv.dps.state.la.us/ for a vehicle statement of non-use.. but I wasn't aware of this.. so when I had the vehicle in "storage" I was suppose to have filed this which would have protected me against a showing of lapse/cancelled insurance.. even though I never cancelled and I was never late on paying my insurance.. Any ways, my insurance company still wants to clear it for me for not making all of this fully aware to me and they are the one who reported it.. however, every time they try to clear it on their end.. the DMV or OMV won't acceept however they are trying to correct it.. My insurance company has sent in a correction 3x's and they still won't correct it..

The point is, no other state I have been in has had such strict and technical requirements.. You aren't required to have insurance on vehicles you don't drive.. only when you are driving them.. It's ridiculous how nit picky these things are here.

But if anyone ever has a vehicle they own they aren't driving and don't want to pay insurance on.. I suggest filing the statement of non-use here LINK

Update: It's a penalty with the tag.. so basically they don't want you to have a registered tag to a vehicle you don't have insurance on.. so they want you to turn that tag in if you even temporary change your insurance.. still seems ridiculous.

and then trying to get these people on the phone is a tremendous hassle.



this is why i can't stand louisiana.. we are always among the few states that require strict shite.. regardless what it is.. this is just one example.

I received one of these letters last week as well, regarding a "lapse in insurance" from 2005. I moved from LA to TX in 2004 and have NEVER had a lapse in insurance. (Not to mention the letter went to my parent's address, and was sent to my maiden name, which changed 11 years ago). I've called the DMV about 50 times and 49 of those times, I get a recording that says the are experiencing high call volumes and it hangs up on me. Once I got a guy who said I was in the wrong department and should have chosen option #3. This is going to be a mess.

Just make sure you or whoever is working on this keeps notes of every correspondence, and keep copies of all documents. I was dealing with taxes on a closed business and they kept trying to tax me on something that didn't exist. I found a woman at the state that was working with me to correct the problem. I had her name and all communication went through her. It made life much easier.

I got a notice last week, dating to 2012 issue, though we paid the $125 fine back then (state farm jumped the gun and cancelled insurance when we bought a new car before we sold the old car, going a couple weeks without coverage before we reinstated it). They now claim that if it's not paid in 60 days it increases to $656.25.

It had to be paid by cashier's check 3 years ago and I doubt we kept copies. WWL this morning said DMV offices are being swamped and will be open this weekend to deal with the mess.

Edmonson at State Police said they won't collect debts older than 2006 and that some kind of appeal form is in the works. 1.2 million letters went out on this issue. Typical govt ineptitude

Received this exact letter last week on a truck I bought new then later traded it in a few months later back in 2013. I never had a lapse in insurance and the OMV was claiming I owed $250 within 60 days. Called the dealership that I bought and traded with and they sent the state a bill of sale and invoice. Was cleared within the day. It's pretty much a big money grab by the state. There are a couple articles on wafb website talking about this exact thing. Before I paid the money id def fight it if you have your records or can go to the dealership.
