- The investigation into ex-WWL Radio host Seth Dunlap is at a crossroads after sources tell us a judge denied NOPD's request this week to issue an arrest warrant accusing Dunlap of extortion.
A source with knowledge of the request says NOPD has compelling evidence, but the judge just didn't believe the alleged facts amounted to extortion. Cops can reurge their case for extortion or seek another offense based on the same facts, but it remains to be seen what happens.
In other words, it sounds like the NOPD concluded that he sent the tweet, but the Judge did not interpret it as "extortion".

But would the tweet constitute the "communication of threats" or would Dunlap's demand for $$?

This is simply a matter of semantics: What is Extortion under the law?
Its not judging whether he sent the tweet or not. he did.

I don’t remember in detail what happened here. Was he accused of sending an insulting tweet about a homosexual, and some are trying to blow that up into something bigger?
Just fire and ostracize him like everybody else. Becoming unhireable is an insane enough punishment to set an example and frighten everybody so there will never be open discussion about any issues around this. Just like race issues.
Edit: I see that this is a Jussie Smollett situation, which means nothing will come of it because the law doesn’t apply to the accused.

If he demanded that WWL pay him off because of the defamation done on the company’s social media, I’d say that qualifies as extortion.
And there should be proof of legal demands from his attorneys for “damages” submitted to WWL.

The tweet itself isn’t the issue as much as the accusation that he did it fraudulently to defame WWL and demand damages to be paid to himself.

Seth acted all outraged and took a leave of absence. He then hired a lawyer to sue the station for discrimination.
At a meeting to talk about the case, his lawyer asked for 1.8 million.
At that point, WWL set him up. They revealed that their investigation showed he sent the tweet, and they had video proof he had his phone with him behind closed doors at the time. Traced the IP on the tweet to his phone.
They turned it over to the NOPD.

What about the subsequent meeting where they demanded money? Settlement discussions? Does a suit have to be filed for such discussions to be admissible?

How is someone not demanding 1.8M from an employer due to a hate tweet you faked and said was from said company not a classic case of extortion?
