they're not. they are at the mercy of the owner of the business. non-smokers can go to many non-smoking bars to avoid the issue

Im not political at all. But i never understood how one viewpoint can be all encompassing.

gay marriage is banned due to certain people deciding their morality should be enforced as a law
open containers being illegal is the same thing
so is this law about banning property owners from deciding what to do with their property

No one forces you to be around second hand smoke though. You could easily walk away if it bothers you. The smoker has the same right to be someplace as you do.
This ban isn't about the smokers though. It's about government telling a private owner what they can or cannot do.
