This time build a friendly fence so you split the cost if it were to happen again.

I forgot this was the OT and you'd probably be out there as we speak with a dull hatchet and a headlamp because a chainsaw would be too easy.

File an insurance claim. That's what you pay homeowners insurance for.

more bad news is you'll be out of pocket for your deductible for his tree falling on your fence, and your premium may increase because of the claim.

Unless the tree was a public hazard (aka rotting from the ground up) you have zero case. Even then, it's hard to sue over this.

I had a tree at a rental property uprooted by a tornado last year and totaled the house next door. State Farm paid to get the tree off the fence so it could be repaired and paid for the fence. I had other damages to the house so deductible wasn't an issue. My tree guy just cut the to the property line on the other side of the fence. Neighbor had to cut up the tree on his side of the property line.



There is a 2 bedroom house underneath what is left of the tree after cutting what was on my property.

Meh. From what I understand, a reasonable person would have to be able to conclude it's a danger and all of that.

Good luck proving that shite, especially over a damn deductible, the lawyers would make more money off the case than anyone else.
