90 days for a 1/2 ounce is rough unless this isn't his first offense or he had it in more than one baggie (intent to sell).
Misdemeanor or felony?
In AL if you are popped for a misdemeanor possession charge, the next is automatically a felony no matter the amount. Also, in AL even just a possession charge carries a mandatory 6 month license suspension. This way anytime you are ever pulled over or go through a DUI check point for the rest of your life it shows up when your license is run and gives any officer automatic probable cause to search you and your vehicle.

It's unlikely he'll serve he 90 days. Depends on his situation.
A half ounce is he threshold in many states that separates possession for personal consumption and possession with intent to sell.
Either: 1. Your son has priors. 2. The judge ordered a drug test in court and your son failed. 3. They're saying he was dealing.
I got arrested with less than 2 grams and I was given a 90 day suspended sentence pending my completion of 2 years probation and court ordered drug classes. I was arrested again several months later for Minor In Possession of alcohol, which sent my case for the weed back to court. I thought they were going to just start my probation and drug classes over from scratch, so I smoked. Well the judge ordered me to take a drug test in court and I failed so he had me locked up right then. My lawyer said I would probably serve 30 days out of the 90 days sentence, but after only 5 days I got called back to court, the judge asked me if I enjoyed my "weekend" and released me.

Don't do the crime if you can't do the time.

I'm not reading all the pages so maybe this has already been covered. But ...
If he had priors (which seems likely) then he was pretty dumb to not pay attention to the warnings. You get busted, you do time. It's a simple concept, and no it does not matter whether the law makes any sense.
If weed is important enough to him that he's willing to risk jail time then he should have moved to a more lenient jurisdiction at least.
And yes, sorry you have to deal with this.

It's crazy how different and separated the same country is. I'm sure other places are equally and more different, but to have a handful of States fully legal, and then have others close or far less lenient, and others where it's still extremely strict...is crazy to me.
I mean, by 2025 about the entire north will have it fully legalized, and the South will still be dropping felonies for it. Seems so messed up and wrong.

Did he have a pipe or anything? Pariphenalia gets you a bigger charge in NC, not sure about SC tho.

Chef, get the boy a good lawyer. Go to the lawyer with him. Go through everything with the lawyer, in mind numbing (No pun) detail.
Explain to him his future, if caught again. Explain what happens if he has court appointed urinalysis and fails it.
Get him through it, then kick his arse later.

Man come on. There's more to the story than just a half ounce of weed.

Ok I got a little more info from his gf this morning. Apparently he missed court yesterday morning. Idk why yet, I know he was telling me earlier in the week his clutch was going out in his car. That might not have anything to do with it tho idk. But apparently he missed the docket and when he showed up late he found out they had already tried him in his absence. guess I'll get the whole story when I get up there to see him in the next day or so

And the truth finally comes out.
There's one person you do not want to piss off more than any other in this world- the judge.

In Louisiana 14 g or less is MAX 15 days and $300 fine for first possession. 15 days is usually suspended.
Also you can't be sentenced without him be there. Bench warrant is issued.
So are you the bullshitter or the guppy who believes whatever your sweet boy tells ya?

Seriously, im all about being a little outlaw. I'm 40 and never been busted . You NEVER give the law a reason to notice you. Too late for him now, the local cops see him and will suspect he's got some contraband .
