medical expert fees

Need help from any physicians on here that do medical expert work. I will be going to court on a case soon and was asked how much I charge for court time. I likely will only have to be on the stand for a hour but my hourly fee for depo seems hardly worth it to miss 2 days of work (travel + court). What do you charge for court?

I usually charge somewhere between $300 and $400.

These almost always get settled. Lawyers are just getting all the paperwork together. Make sure you are charging them per page of notes you have sent.

$3000 for an hour depo, $750 every hour after that. Also $750 for just the lawyer to come sit and talk about the case.

Keep in mind, this covers the time taken to review the case, the lost productivity of not seeing patients or operating, plus the testimony.

Forgot to add, I’m a trauma surgeon, so a PCP fee schedule may be different.

Thanks...do you also charge for travel related expenses or fold that in to your fees?

Go join the Facebook group called Physician side gigs. You'll need to verify your status as a physician. May take a few days. You'll get good answers there and can read what others have said/done. This is frequently covered/discussed.

You need to itemize a bill for whatever figure you decide on per day - would start that conversation at $1500 (you are still losing money) and travel/lodging/food, and present the attorney with a payable invoice for the whole shooting match. It is generally customary to let them know ahead of time what you bill is for each charge. If you want something to tie it to, take your usual daily wRVU generated x wRVU dollar amount you are compensated on (if this is your model) and you can get a good fair number.

The reply was to someone else, but you answered a question I had, so:

TBH, I haven’t charged travel and lodging because they either come to me for depos, or the trials have been in my city.

I can check our department fee schedule tomorrow and report back. But I would do what the other guy above me said. I know I have to make (collect) $2000/day to cover my overhead plus salary. You should be able to figure this out with salary + benefits over 240 (ie 48 weeks of 5 days per week). Don’t forget to include malpractice, office overhead, etc in your benefits. Beingh a Hospitalist, your malpractice will be an order of magnitude less, so your per day will be less.

You will also need the figure in the cost to hire an attorney to collect your fee from the attorney that hired you for your expert opinion

Heres the follow up like I mentioned yesterday.

For Trial Testimony, my departments fee schedule is $6000 per day, plus expenses.
