Trespass and nuisance possibly. It would probably be cheaper and easier to just work it out with the neighbor and leave filing suit as a last resort.

No it doesn't unless that is stated in the legal property description/survey. In this case the property lines were designated at a specific location prior to the pond encroaching on the OPs property.

It's your pond now too. And it's jurisdictional. Just go ahead and consider it part of a stream.

I wouldn't issue a permit for any repairs of the pond and if it was built within the recent past have the owner remove it.
