I'd be interested in reading some case law on this, because if I were the plaintiff's attorney here, I would harp on some important distinctions. I think this law was passed with the intent to protect ISPs, or general internet message boards like TD or reddit that exist to promote general discussion and don't have control over whether their posters go off the rails (aside from deleting the thread upon discovery). The difference here is they are promoting potentially libelous content to be posted on their forum/platform. They're fully aware (or should be) of the harm they could be inviting to innocent people's reputation. Maybe the court would still interpret that law to protect them, but I think plaintiffs here have a stronger case than say suing Comcast because they came across an offensive website

How is the university or the owner of the website liable?

Sue Jane Doe, subpoena the IP and go to the ISP to find the actual person who posted it, but there’s no cause of action against the university or the website owner.

I would really hope the school is not THAT dumb. I mean the site is literally about the school not doing anything if the girl said something to them. If they had/have anything to do with it, they would be admitting they don't take accusations serious.

And while all of that may be true, you’re still most likely dealing with a judgement-proof entity. The Women’s Studies student operating the website has no money and good luck garnishing her barista wages to pay any possible judgment.

There’s probably some bad faith exceptions to 230 but I’m not sure I’m taking the case anyway

This is literally nothing but a witch hunt at this point. Until there are actual punishments for false claims, this will get way way out of control
