I have a feeling the uncle who got out of the car, and who was never charged, might be the ace in the hole witness for the prosecution. Of course if the prosecutor doesn't like his version of events the defense may use him.
Either way, he's too important of a witness not to take the stand.

That's why bringing up the absence of DNA seems moot. The issue is whether it was consensual or even if it could be due to her BAC. And perhaps more importantly, how things turned out.

It doesn't matter if you were drunk. It doesn't matter if she initiated things. It doesn't matter if you were alone in your bedroom and she walked in, undressed and jumped on top of you....you raped her.
I am not saying it is right. That is just the way it is.

There are differences in what “having sex” is for men vs women. Men have to actively participate while women could actually be passed out or even dead and “complete” the act. For that reason, the men are more culpable IMO, if all were drunk.

My point exactly. It's not an excuse to not take responsibility for your actions either. If she was drunk and unconscience then that is rape. If she was drunk but still able to chase them down, get in their car and willingly (in their eyes) do what she did, then it is not rape.

I agree with that completely. Also feel that not guilty is more likely than guilty. It is just sad for the family.

I think by law it is depending on her BAC. But beyond that, the fact she was incapable of providing her address and wandered out into the road where she was killed DEMONSTRATE she was incapable of consenting.
