Yeah I get what you're saying. I always found it bullshite that it's impossible to prepare for some new hardass that decides to completely change up things (and not taking into account that you have many other areas of law to study for.)
Still, keep it mind that when this happens, it's not like they're going to let a huge number of people fail because of it--i.e. they'll throw out the questions no one knew.

Yea, I think the consensus if that they'll have to throw out some questions for code 2 and 3. The shitty thing is we found out about a new code 2 examiner 2 weeks ago, the areas tested have changed for code 3 and for BE, and on top of a new code 2 examiner we have a brand new Federal jurisdiction examiner and a relatively new La civ pro examiner that has cut down repeated questions from 80% in the past to 50% for the past two exams. Such is life though.

Throw out questions? I have no idea. Ive heard it from multiple people, but it's always someone's uncle that knows one of the graders said they throw out a bunch of questions ever year type of thing.

Go for it. The bar exam was a piece of cake compared to the first year of LSU Law School in the 1980's. But it was all worth it.

I've pretty much said frick it to BE.
It's only worth 70 points and I didn't take that class in law school. Obviously I'll review it a bit tomorrow, but I'm not gonna spend a lot of time and stress so much over a section that's going to kill me anyway when I could use that energy to focus on torts and civ pro which are worth way more and are easier anyway.
The consensus amongst the people I've talked to in the last month or so has been that if you're going to punt on a subject, go ahead and punt BE/NI.
