She will have the option to just enjoy her lot, now with the house on it, without being disturbed. However, the builder will likely be allowed to file a mechanics lien onthe property for the cost of the house. So, if she ever went to sell the property, that lien would have to be satisfied / paid.

Similar situation happened back in the '70s in Chateau Estates in Kenner. But thevlot owner discovered the house being built when it was still under construction.

That's repugnant. A good firm would see the easy money on this case a work it knowing they'll get their fees covered at no cost to her.

She needs a 100% discount. They screwed up, cleared the land, and built the house on the wrong property.

Have to agree with you on that.

What’s hard to figure, is (a), how she managed to pick up a piece of land in Hawaii for $22,000 tax value (must be a tiny piece of land), and (b) how they managed to build a house only valued at $500,000.

Must be a tiny house. Construction costs there are sky high.

This is 100% on the developers and their cohorts..

I think he’s right. If she paid them half the cost of the house she would be in great shape. Alternatively, she could quit claim her interest for $250k.

If she tries to get more aggressive than that it risks the developer offering to return the property to the pre-build condition.

Absolutely no way she should accept anything except all persons to vacate the property immediately $$$ to pay the addition property taxes she is now responsible for.

They did not say if the property was fee simple or leasehold which could further complicate this matter.

She’s now on the hook for additional property taxes. There are actually damages here if the idiot developers just left the property alone today.
