Sounds like sarcasm, but unless they can prove he was trying to get into the car, no he didn't deserve to die

If you get out of your car in the middle of the road at a red light to approach someone else in another vehicle, sadly I'm not sure what other excuse you could have?

JM may or may not have been looking to straight up fight, but he unfortunately he picked the wrong guy to confront.

I'm just not sure how they can convict Gasser here unless there is evidence we haven't seen?

Yeah or just not chase after someone for cutting you off.

Someone cuts me off, I honk and maybe flip the bird. I've never once thought of chasing them down, cutting them off again, and starting a huge cat and mouse game.

I don't known how he proves self defense. Had JM touched or hit him it is a different story.

And if you get cut off, chase the guy down, and eventually kill him, what excuse do you have?

If there's nothing showing JM was trying to get into his car, he'll likely be convicted. You can't just shoot someone for standing at your window yelling.

Same here.

Probably what seperates you and I from the rest of the people in these stories.

you’d be surprised what jurors will make their decision based on. I was on a jury recently and a few jurors felt a certain way about the case bc the lead detective came off as a prick so they were willing to disregard testimony of the defendant. Defendant said that they shot someone and it wasn’t self defense but people still wanted to get the defendant off on self defense bc they didn’t like the detective.

"I only got out of my car because this guy was acting like a nut," Gasser's statement read.

This is how I know he's full of shite. If someone's "acting like a nut", you don't get out of your car. That's idiotic.

When JM approached his car and "tried" to get in...why didn't he just drive off? Did he not want to break the law and run a red light?

I'd probably try to get away myself, but there was no where he could drive due to traffic around him.

Also, you're not obligated to back away from the confrontation, hence the term "stand your ground."

He was boxed in on all sides.

Also, he is afforded the right to stand his ground. There's no expectation of fleeing ans failing to flee can't be held against him.

Prosecutors are also reporting findings that there was no gunpowder residue on Joe’s body, which is inconsistent with the report from Glasser on how close Joe was when he was shot . The DA said this was a red flag for Glasser

There's more to the statute than just trying to get into the car.

You're missing the AND part. There are two elements to the self defense statute.

What do you mean?

quote:

)(a)  When committed by a person lawfully inside a dwelling, a place of business, or a motor vehicle as defined in R.S. 32:1(40) when the conflict began, against a person who is attempting to make an unlawful entry into the dwelling, place of business, or motor vehicle, or who has made an unlawful entry into the dwelling, place of business, or motor vehicle, and the person committing the homicide reasonably believes that the use of deadly force is necessary to prevent the entry or to compel the intruder to leave the dwelling, place of business, or motor vehicle

quote:

B.  For the purposes of this Section, there shall be a presumption that a person lawfully inside a dwelling, place of business, or motor vehicle held a reasonable belief that the use of deadly force was necessary to prevent unlawful entry thereto, or to compel an unlawful intruder to leave the dwelling, place of business, or motor vehicle when the conflict began, if both of the following occur:

(1)  The person against whom deadly force was used was in the process of unlawfully and forcibly entering or had unlawfully and forcibly entered the dwelling, place of business, or motor vehicle.

(2)  The person who used deadly force knew or had reason to believe that an unlawful and forcible entry was occurring or had occurred.

They have to be attempting to enter or have already entered.

You can't shoot a guy who is walking up your driveway, for example.

There are two elements to the statute:

1) They must be attempting an unlawful entry

AND

2) they must have a reasonable belief (objective standard of the reasonable prudent person) that DEADLY force is necessary to stop the entry/get them to leave.
