appointed federal judge,Kato Crews, in Colorado has ruled the dude can play in the Mountain West Conference tournament.
The federal judge would be in position to uphold a rule put in place by the ncaa or the conference if and when challenged.
IMO, the NCAA and conferences should be catching the most heat for this.

Boise State beat Nevada yesterday evening and has now withdrawn from the Mountain West tournament. They forfeited twice to SJSU during the regular season and will forfeit again, instead of playing SJSU in the semifinals of the MWC tournament.
Good for those young ladies for standing up and staying strong for their beliefs. I’m also heart broken for them not getting to live their dream of winning a conference championship because some fricking dude had to ruin it for them.
