Legal Question

So last night, my lady friend, her sister, and her sister's kids were watching a movie. Her sister broke up with her boyfriend because he started abusing her. And she wasn't putting up with that. So he's been threatening her through texts and showing up at her house.... Where her and her kids love at alone. So she's been staying at my lady friend's house with her parents. And last night, he showed up there and tried getting in. Neither of them shoot guns (I'm popping her gun cherry this weekend) and the man of the house was sleeping and I'm an hour and a half away. They have plenty of guns in the house.

There's a warrant out for his arrest but for whatever reason, the police won't take him in yet. I know if he got in the house, they'd legally be allowed to shoot him.

But let's say they shot him while he was trying to get in. Would they be in trouble for that?

No pics. Lady friend used to be my avatar image and got warned for it.

This is absolutely correct. If anyone walks into your house you can kill them. No questions asked.

Shoot him on the steps and then drag him in. Be sure to clean the blood off the steps. I'd suggest using some bleach

No need. The law says you can shoot somebody for trying to open the door.

It really sounds like you, your gf, and her sister are plotting to murder her ex-boyfriend and you stupidly asked the internet if your plan is foolproof.

No. We don't want to. But he keeps showing up. If he shows up while I'm there, I'm going to do what I have to do to protect them. I told them to wake the man of the house up. But they were afraid he'd take matters into his own hands and get in trouble.

Just a point of clarification. So your old lady's sister and her kid are living with you and getting harrased by your lady friend's sister's ex? Is he the father of said lady friend's sister's kid?

Regardless...you are trashy and I imagine there is only one door to your "house."

You need to advise the sister of your lady friend to file a non contact order against this a-hole. However, ineffective against a physical attack, it will start a paper trail. If he violates the NCO he will face felony charges, to include telephone/texting harassment. Judges don't frick around when it comes to violating a NCO. DV violence is no joke in any municipal court.

You can call the warrant in, if you know where he lives. The reason why the cops aren't executing the warrant is because it's probably for a misdemeanor and most departments don't have the man power to mess around with petty crimes. Nevertheless, if's worth a shot. You may be saving this girls life if you do.
