Well, one could theoretically dismiss the current divorce proceedings and refile for requesting spousal support. Even though "fault divorces" are no longer a thing in Louisiana, fault can play a role in the amount of spousal support awarded.

Sure, since this cannot be seen as a cause of the breakup. even if it were the cause, it only means that he cannot receive alimony from her. the one seeking alimony only has to proof that she is without fault in the breakup, not who has the most. if you have fault, you don't get final support.

With the amount of people who claim to be lawyers on this board, the lack of legal knowledge is alarming.

There's no fault divorces, if they are separated, etc. Where do y'all hear this stupid shite?

Once the petition has been filed, it isn't adultery anymore. Unless you reconcile, then it retroactively becomes adultery?!?!

I don't know if this is a moral question or a legal question. Morally, you're already admitting the marriage is over and I think it's fine to get back in the game as long as you and the ex have an understanding that it is indeed over and no reconciliation is coming.

Legally, I really don't know the law. But again, if the ex agrees it's over and the two mutually agree they are done, there's really no reason to pursue legal action unless either person is a lunatic.

My argument to him was that I thought u couldn't see other women or date a woman(have sex) until divorce but hearing otherwise....I mean u can but if u were caught, it can cause a court to hammer down on u?

If the guy has filed for divorce, subsequently banging a new chick is not useable as fault in that divorce. These days all fault gets you is a quicker divorce(immediately vs. waiting a yer with a minor child) and no alimony. Since dudes virtually never get spousal support, it doesn't matter. However, it will make wifey very angry, and they can be really evil when angered. So best to keep it on the DL.

If there is a minor child involved, he needs to wait until the divorce is finalized. In these situations, the only thing the court gives two shits about is the child. So by starting a relationship with another woman, he risks pissing off the Judge, being assigned a Guardian ad Litem, sacrificing a portion of visitation, and drawing out the proceedings.

Unless there are extensive financial assets which by themselves will cause the divorce to last a coupe years, or if he doesn't care about custody, it's not smart.
