Should have noted that at first. Sounded like you were just switching lanes the way you worded it at first. Sounds like you're at fault but stuff happens. He was probably hiding behind that truck and you couldn't see him.

Unless you're near an intersection (where it is illegal to shift lanes) I think the people in the road have the right of way to shift lanes. I'm actually interested to find out for sure though.

If you argue hard enough that the other driver didn't initiate/start their lane change until AFTER you entered the lane of traffic, you might get the cop to not ticket anyone and insurance might do a split.

Honestly document how many people were in the vehicle when the accident occurred. I had a major accident in New Orleans when I was in high school and when I hit the car (pretty much head on and broke my ankle) there was two people in that vehicle. By the time police arrived they had 6 people there claiming they were in the car and injured ..

why, if your insurance pays them $500 or $500,000, it doesn't really effect you. Your insurance premium won't change based on how much they pay out, only that you were at fault. It's not your job to investigate fraud.
