I said initially. Joe cut him off, Glasser then starts chasing him, and they go back and forth until the shooting.

BTW....Gasser was already at the red light when JM came from behind and pull up next to Gasser on the shoulder

bullshite. It was a driving lane. JM was obligated to stop at the red light too, and did so in the lane beside Gasser.

A lane that wasn't a lane

McKnight was in the empty spot to the right of glasser's blue car

Does a "reasonable person" engage in a road rage incident for miles and miles? That's what's gonna decide the case imo.

What legally determines what a "reasonable" person?

quote:

The decision whether an accused is guilty of a given offense might involve the application of an objective test in which the conduct of the accused is compared to that of a reasonable person under similar circumstances. In most cases, persons with greater than average skills, or with special duties to society, are held to a higher standard of care. For example, a physician who aids a person in distress is held to a higher standard of care than is an ordinary person.

If the evidence shows the JM was the aggressor, what "reasonable" person wouldnt run or protect themselves?

It’s up to the jury to decide. theres plenty of video that will show whether or not gasser could have avoided the situation if he were being reasonable. Safe to say you can’t act like a jackass leading up to the shooting And then try to claim self defense / that you were being reasonable.

I think the fact that it wasn't a lane might help Glasser and co prove JM was the aggressor.

Would a reasonable person do what JM did?

McKnight doesn’t have to prove he was reasonable. He’s dead. Gasser is the one who had to be reasonable to claim self defense.

Well based on the parking in the photo, Gasser was in a reasonable spot and JM wasnt.

It's a reasonable belief, not reasonable person.

Here's the exact part about vehicles

quote:

4)(a)  When committed by a person lawfully inside a dwelling, a place of business, or a motor vehicle as defined in R.S. 32:1(40) when the conflict began, against a person who is attempting to make an unlawful entry into the dwelling, place of business, or motor vehicle, or who has made an unlawful entry into the dwelling, place of business, or motor vehicle, and the person committing the homicide reasonably believes that the use of deadly force is necessary to prevent the entry or to compel the intruder to leave the dwelling, place of business, or motor vehicle.

It will depend on if JM was trying to get into the car.

2) When committed for the purpose of preventing a violent or forcible felony involving danger to life or of great bodily harm by one who reasonably believes that such an offense is about to be committed and that such action is necessary for its prevention. The circumstances must be sufficient to excite the fear of a reasonable person that there would be serious danger to his own life or person if he attempted to prevent the felony without the killing.
