The law has nothing to do with it????? Ok what will determine his innocence or his guilt?
Posted on 1/16/18 at 10:30 am to CarRamrod
I worded it better above. If the police determined it was plain as day self defense like so many people are saying in this thread, the charges wouldn't have be brought up. Why bring a case to trial you know you're going to lose in embarrassing fashion?

That specific one doesn't.

This part of the law
quote:
Louisiana State Legislature. A. A homicide is justifiable: (1) When committed in self-defense by one who reasonably believes that he is in imminent danger of losing his life or receiving great bodily harm and that the killing is necessary to save himself from that danger.

Why are people in here saying McKnight chased Gasser down in his vehicle?
because he did...and yes there are reports of that happening
BTW....Gasser was already at the red light when JM came from behind and pull up next to Gasser on the shoulder

ok hang on,.....I know there are reports that the traffic cameras or security camera on the route show them weaving in and out of traffic and JM following Gasser and vice versa

Yeah that's the only thing I've seen. Then articles say JM pulled up to the light next to Glasser but that doesn't indicate a passage of time or anything. Could've been 2 seconds prior or 2 minutes prior.

No, he's saying

If he goes to jail it will be due to total disregard or misinterpretation of the standing law and he should be able to appeal.
Why are you so combative? no matter what is said you have to critique it to fit your message. It makes you look like a dork.

For it to be self defense it has to be something a ‘reasonable person’ would do
Where does it say this in the law?

If someone is attempting to gain entry into your vehicle, you can legally shoot them, armed or not

He's saying if he goes to jail it will be because the law was misapplied and they determined he should've driven off.

Gasser believed that he was in imminent danger of losing his life or receiving great bodily harm. Case dismissed.

The incident possibly began with McKnight's vehicle cutting Gasser's car off, Normand said. In response, Gasser pursued McKnight in a heated "road rage" encounter involving shouting and swerving through traffic that led to the intersection of Behrman Highway and Holmes Boulevard. There, McKnight exited the gray Audi Q7 SUV he was driving, approached Gasser's blue Infiniti G37, and

Normand said investigators used video footage from dozens of business surveillance cameras along the way, and testimony from dozens of people, to try to reconstruct the chase.
The sheriff said both Gasser and McKnight were "driving erratically," with one witness singling out McKnight specifically as driving erratically across the bridge.
Around then, Normand said McKnight possibly cut Gasser off. According to a statement given to police, Gasser said he was "irritated" by the cut-off and "set out after Mr. McKnight," Normand said. What followed was a heated cat-and-mouse road pursuit in which Gasser and McKnight "engaged each other many times" as they exited the Gen. de Gaulle Drive off ramp and turned right onto Behrman Highway.
All the while, Gasser and McKnight were shouting at each other through open windows, Normand said, "on each other's tails, cutting in front of one another, zipping around vehicles, on and on and on."
quote:
The two then came to a stop at a red light at Behrman and Holmes, with Gasser positioned in front of McKnight. McKnight pulled around to the side of Gasser's car, which was then "hemmed in" on all sides by McKnight's and other vehicles, Normand said. Arguing between the two men continued.

Does a "reasonable person" engage in a road rage incident for miles and miles? That's what's gonna decide the case imo.

They dont have to. The evidence will show that JM got out of his car and approached Gasser car.
