Breathalyzers are pointless, except to use refusal as cause to arrest you. The margin is too wide and they are inadmissible in court. Field sobriety tests are the way to go. If you can't complete a field sobriety test, you can't operate a vehicle. Similarly, if you are over the legal limit, but can perfectly complete the sobriety test, you are not driving while impaired nor driving while intoxicated, which by definition is "(of alcoholic drink or a drug) caused (someone) to lose control of their faculties or behavior".

On that note, do they arrest everyone who is simply driving while tired? No. Only if it impairs your driving. Alcohol should be the same way. There is no absolute value that dictates everyone is drunk or not drunk.

I agree, I'm saying they don't just go around like "How long have you been awake? Oh, 18 hours? That's too long, you're under arrest." like they do with breathalyzers. You can't quantify impairment. It's a judgment call, and the field sobriety test is the best way.

My new metal ankle if I was ever pulled over I think I would take pass on test.

Watching live PD I hear cops calling out misses on heel toe but looks like they more less got it to me

That's why they use the 3 tests together. The HGN is the best one. As far as the walk ad turn, they don't just look at if you can heel toe... they look at how well you balance during instructions and if you begin before they finish, if you stop while walking to regain balance, how many steps you take, etc.

pretty sure those tests are designed with failure as the objective, how can a one size fits all cover such things, as your ankle, arthritis, recent injury, hell, just being sore from a typical OT leg day at the gym?

Yep probable cause and develop case. I would prefer they establish number and test with blood test
