I think it is a good middle ground, problem is that some people hold their liquor better. There should be a standardized impairment test. I can drink a 12 pack and still drive between the lines all day but my girlfriend gets loopy as frick after half a drink. According to our BACs, she was probably less drunk than me but can't deal with her alcohol.

counterpoint: There always needs to be discussions of whether a particular law is just, still necessary, etc.

Substitute DUI for Fugitive Slave Act, laws preventing women from voting, etc. and see if you still feel that "it doesn't matter if it's right, it's the law."

Lots of people can't pass field sobriety tests when sober. My dad has MS and there's no way in hell he could complete 99% of the tests they use. Literally the only one I think he could complete is the ones dealing with eye movement. However, he can drive perfectly fine still. I have no problem riding in the car with him.
