You literally said blacking out doesn’t count as non-consent. Ergo, even if a chick agrees to sex then passes out due to alcohol before even beginning and you frick her... well, you have a problem. Passes out and blacking out are not the same thing. I’m not saying that was the case here, but just because you’re blacked out doesn’t mean you can’t physically have sex.

I think everyone is in agreement that a passed out woman cannot have sex, and if anyone disagrees, frick you.

look man we all have to make our own decisions.
if a girl I’m with passes out, I stop and don’t start again until I know she’s back in the saddle. It’s worked for me so far as I’ve avoided sexual assault chargers

Is there some phenomenon I’m unaware that says these two states are mutually exclusive?

She may say blackout. That doesn’t rule out that she potentially also passed out as well does it?

Hence the issue fricking on drugs/booze.

After you've spent a fortune in attorney fees, on bail, and the potentially limitless hit to your reputation. I'd say the first order of business immediately prior to copulation is to ensure your partner is conscious and lucid. At least a cursory check. Because alls it takes is for that four letter word to be thrown at you via the police, and you're about to have at least a brief period of extreme discomfort in life. Better safe than sorry in these matters.

A drunk "blacked out" means they don't remember, not that they were passed out or unconscious.

It's a double standard to say that consent while being black out drunk isn't valid and yet holding a guy to 'rape' when both parties are the same amount drunk. Record your escapades if you're out on the prowl. Record her coming on to you, record your lead up and full sexual encounter for your protection.

But none of this ever happens if the guy isn't Muslim. That's all that got him off in MN.
