You've never had consensual sex without the being a verbal agreement?

consent is granted continuously throughout the encounter and cannot be offered when unconscious. It should bother you that this has to be explained to you

So she consented until.blacking out? And upon waking, possibly 30 seconds later, he's supposed to know she changed her mind?
You don't know that...any of it, the=es no way to know...because, not even SHE can remember

Are you retarded you dumb count?
You literally said blacking out doesn’t count as non-consent. Ergo, even if a chick agrees to sex then passes out due to alcohol before even beginning and you frick her... well, you have a problem. Because suddenly she has no ability to rescind consent at any point if she’s not conscious. Or do you actually believe consent once given can’t be taken away?
So. Go frick yourself you clown arse fricking bitch.

Passes out and blacking out are not the same thing. I’m not saying that was the case here, but just because you’re blacked out doesn’t mean you can’t physically have sex.
I think everyone is in agreement that a passed out woman cannot have sex, and if anyone disagrees, frick you.

look man we all have to make our own decisions.
if a girl I’m with passes out, I stop and don’t start again until I know she’s back in the saddle. It’s worked for me so far as I’ve avoided sexual assault chargers

Funny that this got so many down votes.
BLACK OUT DOES NOT EQUAL PASSED OUT.
It simply means as far as he knew she was completely conscious and functional but she doesn't remember how she got in bed with him.
It's like blacking out and waking up at waffle house in the middle of a conversation with people.
Did they abduct you and bring you to waffle house?

Third degree rape in LA. I've never seen it successfully prosecuted.

I think this is what is confusing people
“I was so drunk I don’t remember driving home last night” blackout
“I fell asleep on my front porch before I could get in the house” pass out

Mora of the story should be simple. Don’t frick a drunk stranger if you don’t wanna risk the potential fallout.

Is there some phenomenon I’m unaware that says these two states are mutually exclusive?
She may say blackout. That doesn’t rule out that she potentially also passed out as well does it?
Hence the issue fricking on drugs/booze.

After you've spent a fortune in attorney fees, on bail, and the potentially limitless hit to your reputation. I'd say the first order of business immediately prior to copulation is to ensure your partner is conscious and lucid. At least a cursory check. Because alls it takes is for that four letter word to be thrown at you via the police, and you're about to have at least a brief period of extreme discomfort in life. Better safe than sorry in these matters.

Perhaps she did say 'yes', but she simply doesn't remember.
A drunk "blacked out" means they don't remember, not that they were passed out or unconscious.

It's horseshite how many college aged men have had their lives ruined because some little sorostitute doesn't want to admit to daddy that she got drunk and had a one night stand.

Minnesota is a really screwed up state.
Posted on 3/27/21 at 7:34 pm to VADawg
It's a double standard to say that consent while being black out drunk isn't valid and yet holding a guy to 'rape' when both parties are the same amount drunk. Record your escapades if you're out on the prowl. Record her coming on to you, record your lead up and full sexual encounter for your protection.
But none of this ever happens if the guy isn't Muslim. That's all that got him off in MN.

I’d have made way better grades in college if I wasn’t trying to frick drunk strangers every night
