If the traffic stop (for speeding, as an example) is unnecessarily prolonged to bring in a drug dog when no reasonable suspicion of drug activity is apparent, then it is an unconstitutional seizure. Now, what is considered "unnecessarily prolonged" is up to the court, and that varies wildly. Generally, if it takes 20 minutes to run ID and write a ticket, then that's the window allowed -- not 45 minutes, not an hour.

Yet, it happens all the time -- someone refuses a search during a simple traffic stop, and the drug dog gets called... and they wait on the side of the road. Big no-no, but again -- it happens all the time.

There's an old saying... you might beat the rap, but you won't beat the ride.

so what would you rather police do? never suspect anyone of doing anything?

In no way am i part of any problem. I've never had an altercation with police, nor will i ever have one, despite being pulled over probably 20 times in my 15 years of driving.
I'm not a criminal. If everyone else was like me, and not a criminal, maybe we wouldn't have stops like this b/c they would never suspect anyone of anything.

Pretty much. Should protect and serve.

Cops have quotas to meet and no the easiest way to get them. If they step into the gray area they aren't worried because maybe a few peoples rights are violated while getting their quota filled.

OH has specific statutes I believe, I'll not an OH LEO. However it is across the board permissible for police to identify passengers during a lawful traffic stop.


Can you defend your rights? Yes. Is the best place to do that on the side of the road during the stop? No. Should you be able to record? Yes. Is it more effective to remedy this in the legal system? Yes. Keep the recording to yourself. In a few years hire me, and if there was wrong doing we state your case. In a few years it will also be my job to tell you when you have no case. In order to assert your rights you have to know your rights and the law. Most importantly leave your emotions out of it.

Thank God for the War on Drugs.

Where would we be without these noble public servants harassing and detaining people who may or may not be selling a product to willing buyers?
