If he has collision his insurance will cover it less his deductible. They'll tell you they will go after her but you will never hear from them again.

Since he doesn't have UM they will cover it then either drop him or raise his premium.

I went through this. An illegal from south of the border backed into my vehicle. I had to pay for it while my insurance said the were going to collect from him. After a year and a half of waiting, I switched insurance agencies. 3 days later I get a letter from my previous insurance agency they had been unsuccessful.

I think it's stupid that your insurance could be moot if the other person doesn't have insurance. What's the point?

This is Louisiana---always carry FULL coverage, and not the minimums, uninsured motorist coverage is a must---you'd be amazed at the amount of people in this state with no insurance.

I'm not sure uninsured motorist covers your own property anyway. It does pay for medical bills.I think now they sell a separate rider for uninsured property but I'm not sure. I carry collision so its mute.

Can't penalize him for an accident that wasn't his fault.

If you have collision, go thru your insurance and incur your deductible. Should your ins co collect anything from this person, you'll be reimbursed as soon as they recoup whatever your deductible may be.

If you don't have collision or UMPD, you may be SOL.

This is assuming you aren't hurt.

As a long time police officer I will tell you that if you don't have uninsured motorist you are taking a serious risk.

Call the police and have a warrant put on her arse for no insurance.

Unfortunately, you need to file a claim under your uninsured motorist clause of your insurance policy to get your vehicle repaired, then leave it up to your insurance company to either subrogate with her insurance or sue her as the driver.
