Sorry for speaking in absolutes...it's a nearly negligible part of the American workforce that isn't required to pay FICA (off the top of my head, some resident/non-resident aliens, some clergy, university student employees and a few gov positions are exempt). Your son wouldn't qualify for a majority of these positions being an US citizen. As far as I know, government jobs require the new employees to register on E-Verify, which requires the employee's SSN

You also have to consider the other employment taxes of FUTA and SUTA, which require the employee to have a SSN/ITIN. Your son would be looking for a job that's exempt of ALL employment taxes...so student employee with a very low salary cap, maybe a few clergy positions.

Or he can earn money under the table or from illegal activities. Still supposed to pay tax on those types of income though (there are instructions on the IRS website on how to properly report drug money and assets acquired from theft). So even these income sources technically require your son to have a SSN.

What everyone was told and what everyone believed was wrong. Even when the law specifically said I was correct in plain English.

Congrats on the win, but a state department of motor vehicle and the IRS aren't comparable. The Internal Revenue Code is pretty clear on what is and isn't allowed. It's not a fun read and you can barely consider it English, but you should read the sections that pertain to taxpayer identification number and gloss over all the court cases that have challenged various aspects of it. I think you'll find a SSN isn't the hill you want your son to die on.

Interesting thread. My county website says a SS card is required documentation for a permit. If you follow the links it says that the card is required for all who have been assigned or are eligible. Can you come sue them too?

I'm wondering if this thread is even legit. It all hinges on a SS law that states no state agency shall deny benefits because a SSN is not disclosed, but it has two major exceptions:

the[330] provisions of paragraph (1) of this subsection shall not apply with respect to—

(A)  any disclosure which is required by Federal statute, or

(B)  the disclosure of a social security number to any Federal, State, or local agency maintaining a system of records in existence and operating before January 1, 1975, if such disclosure was required under statute or regulation adopted prior to such date to verify the identity of an individual.




So if this is legit, either LA did not have a DMV before 75 or they didnt require an SSN at that time

I’m with you on this. I resent the hell out of needing my ss# for everything! Believe it or not, your social security number was never supposed to be used for identification purposes. That promise is the only way they got it passed. Look at it now. You can’t do shite without it.

I like the concept, but I don’t see this ending anyway other than your son still having SS pull out of his paychecks, even if he can’t draw on it later.

I wish I had the option to opt out, even back when I was only 16y/o.

Minors do not pay FICA either.
