The issue is that if he finds out you later sold it to the person leasing the house then it will be easy for any attorney with a pulse to prove that you made an effort to purposely null the contract to avoid paying the commission. If he pursued it, I don't see how he would lose. He brought the tenant and obeyed the contract unlike you who would be acting in bad faith to null it.

Remember that there is risk for me here, too. I could get into a situation where the chick decides she doesn't want to buy it after I do this little maneuver. Several things could go wrong for me.
As for my conscience, it's frick me over many a time when I should have come out better. I want the ethical guidance of the OT, where all the ballers are.

I don't doubt this at all. I can't believe what people are paying for rentals. I guess it also has a lot to do with people not being able to get mortgages as easy as they used to and it seems like more people have shite credit these days.

Null it? No. I would be doing something well within my rights and that HIS contract didn't address. A very short break in the lease to her and an intervening lease to somebody else. That's why the dude wrote in there a 3-month waiting period. He realizes this KIND of thing could happen. But he obviously assumes some risk that somebody very committed to doing this can make it happen.

I won't argue with anybody who says it's poor form. That's what I wanted: people's opinion on the level of shadiness, of which I acknowledge there is some.
But I welcome an argument about how he could sue me for breach of contract.

It's standard in all rental agreements with any real estate agency. The thing is that if you didn't want to do this then you could have negotiated the contract language prior. You can't do it after the fact and think you are skirting the issue by being fraudulent.
Do what you want because you seem to have already made up your mind but if he sued he would win IMO based on what info you have shared.

Real estate agents annoy me as the next guy but I will never understand this kind of thinking. You should not have entered into an agreement you didn't intend to honor or planned to weasel out of with a completely fabricated technicality. On a very basic level, it's just a very poor statement on how you view other people. Not to mention these things tend to reverberate if you have any other personal professional connection in the area.Plus your karma would be screwed. The Universe would throw a shite sandwich back in you in short order. It's science. I just don't get how you think this would be acceptable on any level other than OT.
