How do bail bondsmen operate?

$75,000 Bond, bail is $9,000 in ebr.

You hire a bond company how much will it cost if defendant makes his court date and how much collateral do you have to put up? The bail amount or entire bond?

ETA- I’m sure the OT is loaded with people who have had to hire bondsman...is Super still in prison?

Wouldn't be any point of hiring a bail bondsman if you had to put up the full amount

Bondsman puts up the full bail and you pay the bondsman usually around 10% fee. When you appear in court, bondsman gets back the money he put up for your bail and keeps the 10% fee you paid him.

I agree but my friend doesn’t.

Let’s say the bondsman charges 15% and bail is 9k...I say bondsman charges $1,350 my friend says it’s 15% of the 75k for $11,250.

I think your question indicates a fundamental misunderstanding of the terms.

The court sets the amount of bail. You can put up that full amount in cash or put up property (I think it has to be valued at like 120% of the amount of the bail; rarely done). You show up for court and be a good boy, you get it all back when it's over.

More common is you hire a bail bondsman who posts a bond (essentially an insurance policy) for the amount of the bail. It has to pay off the full amount of bail if you skip and run to Mexico. You pay him a premium of about 12% of the amount of your bail. That premium money is gone. You don't get it back no matter what.

The bail bonds biz is scummy as hell. And it doesn't work. Studies show that people who bond out are no more likely to appear for court, and they are just as or even more likely to commit crimes while out on bond. But the bondsmen contribute enough money to political campaigns that they stay in the process. A few Louisiana judges have gone to prison because of their relationships with bondsmen.

It's about 11% in EBR. I've had the misfortune of bailing a few people out.

That’s not how it works. The bondsman doesn’t put up the full bond. They pay the fee to the jail depending on charges and all. If the person skips out, the bondsman has a set amount of time to find him. If not, they are on the hook for the full amount. This is where the insurance comes in. The bondsman insurance pays the full bond out of the bondsman own money before they use theirs. It can be a very lucrative business. As far as what percent, it is actually a range they can use and it is set by law.

you and your friend are idiots

Based on your scenario:
Bondsman puts up $75k promissory note

You pay bondsman $9k that is non-refundable

Bondsman gets the $75k note returned when you show up in court

You are basically paying 9k to stay out of jail because you cant afford the full amount. You are paying them to loan you the rest.

That is why bounty hunters exists. They are down $64k if you jump bail. They are not fans of that move.

My understanding is you pay 10% to the bondsman of the full bail, non-refundable.
