HOA- Annual Dues increase

Just got a letter in the mail that our board has elected to raise our dues. As in no vote was held for the residents. My neighborhood doesn't offer any amenities and the dues were already ridiculously high. What happens if I elect to only pay the old amount, the amount I agreed upon when buying a lot and building my house?

I wouldn't go that route, as they will put a lien on your house...

Legit question. HOA's can be frickers, ask to see last years expenditures and bank statements. My last HOA was MAKING money and had $20k in the bank when they discussed raising dues. They backed off eventually.

Do the by laws allow them sole authority over rate increases?

They can sue you, get a judgment, including their attorney fees and court costs. Proceed with caution.

They have not mailed that out yet. Last year there was not much money left as this neighborhood is still being developed. Over 50% of the lots are empty.

Not sure how you get on the board. Over 50% of the lots are still empty and the developer still owns them. He is also a resident of the neighborhood. So I guess he can just make this change since he still owns the majority of the lots. Honestly I don't know. Guess I gotta do some reading.

Carriagewood Estates? I just got the same letter. The pond behind my house looks like a swamp, I'd like to know where are dues are being spent. Especially considering they decided to hire a third party property management company.

They can not raise the dues without a vote from all homeowners, must be 50% or more agreeing to raise it, the bylaws would have to be changed by a lawyer as well.
They can't raise the dues just because they want to.
You do have to pay the dues as written in the bylaws. If not a lien can be placed on your house.

Board member compensation for the time they need to devote to pressing tasks of keeping the community the best it can be.

And remember the by laws were written by the developer, who will give himself the most lienancy in all situations until all lots are sold
