Servers don't generally go after people for no tip, especially when the other party over-tipped (according to you) to make up for it.
The restaurant world would like you to just stay home next time.

Didn't think this thread would last this long 
I didn't think I was committing some OT mortal sin by asking him to take the drink off. And I just bit the bullet and paid when he still did it wrong, the 2 drinks added together was about the price of the tip I was going to leave anyway.
