quote:

Asset forfeiture is a contentious practice that lets police seize and keep cash and property from people who are never convicted — and in many cases, never charged — with wrongdoing. Recent reportshave found that the use of the practice has exploded in recent years, prompting concern that, in some cases, police are motivated more by profit and less by justice.

The Justice Department's equitable sharing program allowed state and local authorities to pursue asset forfeiture under federal, rather than state law. Federal forfeiture policies are more permissive than many state policies, allowing police to keep up to 80 percent of assets they seize.

Asset forfeiture is fast growing -- in 2014, for instance, federal authorities seized over $5 billion in assets. That's more than the amount of money lost in every single burglary that year.

New Mexico's Governor recently signed into law a bill banning CAF in their State. It'll eventually spread to the rest of them.

Kinda funny that no one from Louisiana hasn't at least tried to float legislation like this. Or maybe they have and I haven't noticed.

To be fair they are working to raise revenue for their municipality. The more money they seize from the populace the less they pay in taxes. Just don't carry anything valuable on you and they can't take it away.

Does anyone have any first hand experience with civil asset forfeiture?

I know people, including myself, who have been burglarized, but I've never known someone who has gone through asset forfeiture. I've read horror stories online, but I'm interested in what others have experienced.

With the amount of people profiting off the prison system and LEOs in the state, this will be a long time coming.

I love how the response is always "just don't do ______", even though ______ isn't illegal.

Cops aren't held accountable by your ilk.

Seems irrelevant when the article states the CAF is pursued under federal law rather than state law, but I'm no expert.

Him and his ilk think that police work is the same as serving in the armed forces.

Which is how cops are viewing their jobs these days as well.

Nah, the OP is a notable cop criticizer. He's just being facetious.

It's kind of like walking through a bad neighborhood. Why advertise that you have anything valuable if someone's there to take it from you?

I love living in a state where we will fight to the death for the right to FREELY carry firearms everywhere but yawn when we lose the right to carry cash.
