Character assassination is the surest sign that youre dealing with a simple person or that youve already won the argument.

Your comments exhibit a disturbingly poor understanding of our criminal justice system, as well as poor reading comprehension. tLSU has explained Prieur evidence rulings in detail in this thread. You might consider educating yourself before running your mouth. You won't look as ignorant.
I dont expect you to read it and Im not going to repost it again so Ill just direct link it for you. Maybe you read it. Maybe you dont.

When you say stupid shite in person, everyone you speak to who is more educated, experienced, informed or intelligent on a topic than you are - and I suspect there are many - is thinking "Bless his heart."
Well Im not a braggart so I hope I dont come off as a pompous arse but Ive been on Earth for 36 years and while Im sure this doesnt mean much in certain other parts of the country, I know that here, there havent been many people that have humbled me. Partly because I try really hard to remain humble, open minded, non-committal and try not to dig my heels in but I think also having an IQ of ~138 probably doesnt hurt.
Go back and read the conversations Ive had with a few other posters and youll see that there is in fact a way to converse with people that is much more productive and doesnt sound anything like the way you just addressed me.

Gasser was never able to tell detectives during interviews how exactly McKnight was positioned inside of his vehicle. His initial interview said that McKnight got out of his vehicle, touched my vehicle and i shot him. He also said that he couldnt recall whether McKnight was coming at him or reaching for door handle. He even said that it was possible that McKnight may have been retreating after he saw gun or first shot (cant recall exactly) but i know he admitted that maybe McKnight was going backwards. His example, on video, of McKnights position when he shot him was a lunge, coming within inches of him. That absolutely did not happen.
You absolutely have a right to defend yourself when threatened BUT you can not shoot someone for standing or leaning at your car door with only a hand inside of the vehicle, regardless of what was said prior to them being there. Gasser's life was not in danger at any point during that argument with McKnight at that intersection.
In closing the prosecution made a great point. McKnight pulled up next to Gasser, with only 2ft separating the vehicles. He pulled up to argue because Gassers window was down, even stayed in the vehicle initially (eyewitness). Had he wanted to get out and fight, initially, do you park that close? Gasser baited him out of the vehicle because he had a gun. "Mr McKnight was 6'2" but Mr Gasser had a gun, so guess what? He's 6'7" 300lbs all muscle. He has the great equalizer".

You see. This is the kind of intellectual dishonesty that prevents civil discourse.
You pulled that quote from me but ignored my caveat of
"Well Im not a braggart so I hope I dont come off as a pompous arse"
Also while ignoring the fact that I was responding to someone who was very insulting towards me.

Or McKnight shouldn't have gotten out of his vehicle like an idiot.
There's little doubt that if McKnight stayed in his car he wouldn't have gotten shot at that intersection.
But where/how does it end? They both seemed determined to continue fricking with each other. Maybe one eventually loses control of his vehicle and wrecks or involved in an accident with a third party. Presumably, the "winner" would have finally let it go and then driven home. Or maybe he circles back to taunt the driver of the wrecked vehicle a little more and give him a final frick you.
Both of these guys made several bad choices. Now, one is dead and the other is going to prison for a long while. Way to go, dummies.

What? That I would pull my firearm from its holster in the door and set it on the seat or console in an extremely tense situation? Would you rather be a potential victim?
Are you one of those people that pulls the battery from your fire alarm when it wont shut up? I had to hard wire my fire alarms in my rental property because of people who think that way. Its risky behavior and Im not a risk taker.

We've got gun owners who are practically hoping for an opportunity to use it in self-defense.
If you are insinuating that because Im vigilant that Im some kind of blood-thirsty, commando, gun-nut then youve got it very twisted.

. I'd bet dollars to donuts that at some point in the past Ronald Gasser either read or heard something to the effect of "If he puts his FINGERTIP into your vehicle, you can shoot him."
I agree. Ive had to correct people numerous times who go off thinking that someone walking onto their property means they can blast at them. I usually chalk this up to false bravado or hyperbole but youre right in that many people buy-in fully to these half-truths. It makes for dangerous gun owners.
I was really surprised when the guy in the Marigny shot that teen that was snooping around his car in his driveway. I thought for sure he wasnt justified. I guess there is a big difference in killing a Will Smith or Joe McKnight in self-defense or killing some random joe blow stealing bicycles. Unequal application of the law/justice.

The Merritt Landry situation a few years ago is another example.
Oh shite. Germans. Lol. Im responding to you paragraph by paragraph. I guess I should read the whole post first then respond.

Landry is lucky he's not in prison.

I forget that this caveat, or any caveat to an insane sentence, negates any possibility that the sentence can be taken at face value. It's a hilarious sentence, both in context and out of it. You can be mocked for any reason. You should be able to deal with it, with your 138 IQ.

Thats suspicious. Like hes trying to figure out how best to paint this picture for his looming court case. I imagine thats why its best to conduct interviews as soon as possible. Dont give the parties time to concoct a favorable story.
May studies, however, have shown that people process and regurgitate experiences vastly differently from one another under even benign circumstances.

I sat through the trial, missed the first day though

Why are you being an a-hole?
The guy went after me like fricking prick and insinuated that I was a dumbass. How else should I have responded but to state facts defending my intelligence?
People like you and that other guy make this forum unpleasant. Cant you just have a respectful conversation with people here?

Do you like playing semantics and grammar games?
Does this make you feel good? What content do you add to the conversation and what value do you bring to this forum by picking at inconsequential oversights?

And then you thought quoting an IQ score would prove him wrong? Does that sound like something a normal person would do?

Oh my god you are brain dense.

Oh nut up. It's funny pretty much 100% of the time when people quote IQ scores as defenses of their person/arguments. Not to mention IQ scores which would put them in the top 2% of people.
quote:
Cant you just have a respectful conversation with people here?
I can do whatever I want. I laughed at the fact that you openly stated your IQ score as though that was a defense. That's always amazing and frankly a bit weird. It's also weird how sensitive you are about both your supposed intelligence and being mocked. My suggestion is just to deal with it.

Hey, Near Genius:
Now I'm a prick? Allow me to refresh your memory with your own words.
Unlike Gasser and McKnight, I know when to disengage, so I'm finished with you. I wouldn't want to ruin the social discourse and debate on an otherwise civil and intellectual forum such as the OT. Cheers!

Well, what should have I have said? Lie and tell him Im a rocket scientist? I obviously DGAF what "normal" people do. Who the frick would want to be "normal" anyway?
"It is no measure of health to be well adjusted to a profoundly sick society."

I guess we just have different definitions of funny.

Oh. I didnt know it was that uncommon. I thought it was like 15% or so. Either way its the truth. I dont have a ny reason to lie. Especially since Ive apparently already "embarrassed" myself and am a "moron". If I wanted to lie I would have just said Im a insert impressive position of employment here.
Here watch. Im an unemployed stay-at-home dad. I have no problem with the truth.

I appreciate weird. Uncommon is interesting. Nobody goes to the Zoo to see the squirrels.

Im actually not. Im sitting here typing to you with a big grin on my face. This doesnt have any real affect on my mood IRL. Im not going to go beat my kids because someone on a fricking sports forum was a big meanie to me. Someone made a comment to me and I responded. Thats all there is to it. Seems like youre the one making a big deal about it.
I got nothing else to do until the LSU basketball game but sit here and frick with you.
Ok.
Your turn.
Go.

Well, what should have I have said? Lie and tell him Im a rocket scientist?
Of course not. But generally using IQ scores isn't a good defense against "character assassination," although remarking on the poor quality of your arguments in this thread would not satisfy any definition of character assassination, at least to me.
There could be numerous responses to ad hominem arguments. The easiest would be to call out the fallacious line of reasoning. It's always weird to say you are right because of your high IQ, or insinuate anything resembling such, because we know that having a high IQ doesn't preclude you from being wrong in any particular instance. Thus to suggest that you are right because you are in a profession associated with a high IQ, generally, isn't an accepted line of reasoning either.
quote:
If I wanted to lie I would have just said Im a insert impressive position of employment here.
The only thing that would have any relevance for this thread would be if you were a lawyer, given the subject matter. Nothing else would suffice within the context of the thread. Even then that wouldn't ensure the quality of your arguments, as the reference to your job or IQ as a defense of your arguments would be a fallacious one, as again, none of that ensures the soundness of your arguments.
quote:
Did you see what that was in response to? It absolutely was defense. Im not sure what else you thought it would be.
And it was a poor defense. Any time someone says, "I can't be stupid, ignorant, or ill-informed because my IQ is 130" it is a poor defense. And it is hilarious precisely because of its intent. It certainly doesn't prove your intelligence. Why you would want to use that defense on a message board is both confounding and hilarious. It always is.
quote:
Seems like youre the one making a big deal about it.
Your responses have been comedy gold, partly because you seem so militantly obtuse. When juxtaposed with your supposed intelligence, it has me kissing my fingers like I'm a fat Italian chef who has made an amazing dish.
