Gasser didn't testify in McKnight case; Guilty of manslaughter

Gasser and his attorneys made the announcement to 24th Judicial District Court Judge Ellen Shirer Kovach on Thursday evening, after jurors at his trial spent a dozen minutes going over evidence exhibits in the case. That included the gun used to fatally shoot McKnight, which Gasser claims was done in self-defense. 

The defense's decision to not put on a case suggests it does not believe prosecutors met the burden of proof needed for jurors to convict Gasser of unjustifiably killing McKnight. Gasser faces mandatory life imprisonment if convicted of second-degree murder.




The Advocate

The jurors did hear 3 taped interviews Gasser had with police during the investigation. Gasser's attorneys must be pretty confident. Ballistics show that McKnight's hand was inside of the window, likely resting on the window sill. McKnight was leaning down at the window when he was shot, and he was three feet from the weapon when he was shot. Gasser had a ladder in his car that the state says should prove McKnight couldn't get to Gasser as he contends on the tapes. Gasser told police McKnight lunged at him through the window.

The hand in the vehicle isn't the end all, be all for justifiable homicide. The state will likely argue that deadly force is only warranted if the shooter believes it's the only way to remove the person from the vehicle.

I guess we might see a verdict today once closing arguments wrap up.

He’s fricked. Forensics don’t really match up to his account of Mcknight in Gasser’s car.


If he’s my client, I’m preparing him for a minimum a manslaughter conviction - in which case he’s looking at a sentence of at least 20 yrs.

My guess is that a certain attorney caught wind and reached out. Only a guess though.

I don't think so. Yeah the fingerprints on are the window sill, but if that ladder was there, I don't know if JM was trying to get into the car. 3 feet away from the gun means he was not too far inside the car if at all.

Probably so, if I had to guess. Pretty convinced Gasser is a complete POS, but not sure how you can convict him beyond a reasonable doubt.

The ballistics expert I beleive said it did not appear Mcknights body was very close to the car at all when he was shot. It was explained as McKnights hand being on the window, but with his body crouched back leaned over to talk into the window. I beleive they showed it like this




Will be interesting to see the verdict

Probably because one of his buddies was posting info from Ward's camp that wasn't public knowledge.

Probably a mix of jumping the shark plus legal concerns. I started a thread on the help board asking if we can start up another one as information becomes available.

Thats kinda what I was leaning towards. Feel sorry for the attorney that had to read through all that non sense
