Unreimbursed medical costs
Physical Therapy, etc.
Punitive Awards

There’s not a whole lot of difference in plaintiffs lawyers and insurance defense lawyers.

If you picked them up and switched their practices, they’d do exactly what the other was doing. They just have different business models they’re comfortable with.

PI lawyers are gamblers. They’ll sink money in hoping for the payoff and really hoping for a few monster payoffs.

Insurance defense lawyers are more comfortable with guaranteed billable hours at a guaranteed rate.

Oh we have a guy that thinks you pass one bill and it undies decades of terribleness. Mississippi was judicial bell hole and we dug out of it. It took more than one bill and one year. Florida is a mess and has been openly hostile against insurance companies for years. They passed a bill too but will still take years to resolve their issues

Well the politicians who sold the bill said LA would see an instant drop in the first year. That was their major argument to get support.

What??? Louisiana has been enacting tort reform legislation since Mike Foster was inaugurated. If you file a personal injury lawsuit based on anything other than a motor vehicle accident, a summary judgment motion will be filed by your opponent. It's damn near automatic.

Also, the collateral source rule has been decimated. Seat-belt wearing evidence has been allowed since 2020. And then, don't forget about the lowering of the jury threshold in civil cases, where people like you assume everyone's faking and give them shite damages, if any at all.

Educate yourself before you spew inaccuracies.

It’s common sense if you are trying to protect insurance companies. If you thought dealing with insurance was difficult now post hurricane, Florida will be a nightmare. Insurance companies now have no real downside to giving you the finger on your claim. Lawsuits aren’t just car accidents.
