He could say he Wasn’t over the legal limit until after chugging that beer, when he wasn’t driving anymore.

If he's gonna chug the beer, his better bet is to take the breath test.
He'll be much easier to convict on the refusal than if he would have submitted and blow over then say it was because of the beer you chugged on dash cam.

Smarter to chug whiskey if this is your plan
One beer will o my raise your BAC a little. If you end up blowing a .20 you’re fricked either way
But if you chug whiskey you can always argue that the whiskey eaitger raises your BAC that much or that the fresh whisky in your mouth affected the test

I was a juror on a DUI case and this probably wouldn't really help matters
They don't usually blow until an hour or so after the arrest
Blood alcohol can continue to climb for several hours after your last drink anyway
He'd have to be within a pretty close margin for this to have any effect
And you have to consider intent. He certainly thought he was over the limit if he was chugging beer to try to muddy the results
