Cut them a check, wire it to them, whatever the want.

If there are any issues, talk to the bank.

there is no requirement in La. that you use an attorney. There aren't any forms to fill out, but you can prepare all of the pleadings and file it yourself. i did my own mom's succession with no problems.

but then again i've been an attorney for 24 years.

people typically use an attorney for successions because we know how to do it better than the average heir.


sorta the same reason you hire any professional.

I'm obviously not an attorney either, therefore my job allows much more free time. Or maybe he's not that good of an attorney and has no clients and all the free time he wants.

Just talked to the attorney that is handling the succession.

He said once the Judgement of Posession is signed, checks will be issued to all beneficiaries.

If you are the executor or ind. admin. it is always a good idea to leave a little extra money in the estate account to make sure all the bills are paid. Getting money back from the heirs to pay bills is not fun.

GF is the executor of her father's estate and it's a fricking nightmare. It's taken two years and counting. She hopes to have it finalized this year. One of her brothers has contested everything right down to meaning of individual words in the will. They only communicate through lawyers now, and once it's over I doubt they will ever speak to each other again. Very sad and frustrating. You don't know a person's real character until money or the prospect of money is involved.

I had been licensed for 2 months before I did my first simple succession. I charged $500.00 and took care of what they asked me to. Pay a lawyer or go to law school.

Sadly, this kind of thing happens pretty often from what I understand. Good luck to your GF.

i was amazed while taking successions from Prof. Mengis at the dollar amounts at issue in many of the cases in the text book. These are cases that make their way through the appeals process ultimately to the supreme court. The court costs and attorney's fees far exceed the amounts at issue in some of the cases.

I know all too well how family can get ugly when money is involved. My brother and I went through this with the untimely passing of my father in 2014. We gave usufruct to my mother for the house and their bank accounts but there was the issue of my father's separate property. It was percentage of a family business that his siblings and mother we involved. Long story short business was sold I we got paid but the family isn't on the best speaking terms. At least i got my check tax free

His daily post average is 0.367, or basically 1 post every 3 days. I'm pretty sure you don't need a lot of free time to accomplish that.
