Random tests throughout the probation. If failed, then add a harsher penalty. Also, the handheld portable device my friend had to use was extremely effective toward stopping and this guy liked to drink. The car breathalyzer is a slight deterrent but really easy to get around (albeit still illegal $

How do you do random test? Call him up "come in for a test now"? Or call him up "Hey we need a test. Call me when you get home so I can get a test sample".

Is this really a question? You’re already on probation. Make it a requirement that the person must login to a site to see if they’re selected to piss that day. If they don’t show, or fail then they get popped.

Your friend will get caught by his probation officer if he is not driving his car with the breathalyzer. And if he gets caught driving a car without the breathalyzer then he's going to go back to see the judge who will likely revoke his probation. At the very minimum, they want to see that you are starting your car (blowing into the breathalzyer). They get a monthly report that shows how many times you blow in it per month and if it's below a certain threshold then they will send you to get an expensive drug test done. Usually it'll be for alcohol metabolites, which you can fail a test if you have drank alcohol within the past 3 days to 3 weeks... depending if its a urine or blood test. Happened to my friend a couple years ago.

I agree with everything you said but let’s discuss..
How is your PO going to catch you if you’re driving another car?

Just make sure you drive your “official” car everyday to avoid what you outlined before.

If you’re a night drinker, then just drive during the day to cover this issue up.

Driving with a lack of sleep is as dangerous as drunk driving but there's no laws against it.

Meh, not a huge drinker but have a number of friends that are and have had a couple get popped. We have always just laughed at how easy it is to bet the system.

The PO will know you are driving another car when your breathalyzer report "blows" come back super low. Also, if a cop were to pull you over you are instantly screwed and going to jail. They know if you are supposed to have a breathalyzer in your car. But yes, there are ways around all of this and I agree with your main point.

Yes and no on the night drinking. The breathalyzer in your car usually has a zero tolerance meaning if you blow over 0.00 then you will fail and your PO will get notified. Most people that have a breathalyzer usually aren't drinking just 1-2 drinks the night before. They are usually pounding drinks and wouldn't pass a breathalyzer early in the morning if they had to go to work.

Yes, the issue with driving another car is if you get caught, you’re screwed. Driving another car is asking for it, IMO. And I agree the likelihood of you blowing a 0.00 in the morning after a night of drinking is not happening. Seems that’s the likely time you’ll get busted. I’ve just heard all this talk with my buddies on how it’s easy to get around it. Hell, I even had a friend by a device so he won’t blow dirty in his car.

Seatbelts seem to be constitutional.....

Breathalyzers would be a bit much right now, in current state, but technology could always advance and, one day, detection could be as simple as holding the steering wheel.

I actually don’t think the lawmakers would allow this. They want DWI’s out there to fund most of the counties issues. It also helps cops with their overtime

Thought this little note was appropriate. Friend who is under probation for 1st DWI went to see his PO today. He said he was in there 5 minutes, the officer made a comment about overworking, then sent buddy on his way…

Such a waste of taxpayer $. Why do 1st time offenders have to check in? Put a breathalyzer in car and give them random tests. Law makers are clueless

Exactly!

I have a year of unsupervised probation right now.

As far as driving another car. Get pulled over with a hardship license and you don’t have an interlock you are in a world of trouble.
