Guy suffered a fractured hand, needed thirteen stitches and surgery. Kid is going to be sued along with the fraternity and his dad. Since the kid pushed they guy down two flights of stairs after the guy got up once, the insurance companies will argue that it was an intentional act and there will likely be no coverage. The plaintiff will likely only be able to get a judgment against the kid directly. Most 20 year olds can't pay a six figure judgment against them so he may have to file bankruptcy to avoid a judgment hanging over him for the rest of his life, which can be collected on in many many different ways.

I'd take the judgment against the kid and then see if dad wants to settle for 70 cents on the dollar so it doesn't follow his kid around forever via credit scores and mortgages down the line.

Only if they don't know dad has a little money. Also depends on the severity of the injury.

If ole boy has health insurance and I don't have to pay medicals out of my pocket, what's the risk?

ETA: and it may not get to judgment because Dad is a sharp dude and knows his kid is screwed. Maybe he steps in beforehand to resolve it

Also, insurance company may ARGUE intentional act and deny coverage, but they are going to be willing to throw up some money to make this go away without having to try that issue. A good attorney will have counter arguments to the intentional act.

I don't know how they roll these days but people were more revenge minded in the 90's.

He could have pushed a member of the Chess Club down the stairs and they would be gunning for him later back then.
