DC was emotionally in control the entire time from what we can see from the body cam footage. He went so far as to even assist GF getting onto the stretcher, so this one is out.
This was not what is defined as a “crime of passion” which is what you see mostly with a spouse killing another spouse.
This is clearly an overcharge on the state.

When you look at the definition of this, one can reasonably infer that the information we know now, that drugs had something to do with GFs death.
My question to you is that if he had been completely sober, would he have died then in the same situation? He would have not have had to even be on the ground IMHO.

Nice find, I didn’t even think to google the MN statutes.
Manslaughter is the only charge in play given that definition of third degree murder. DC did a hold that is part of the MN police handbook. This is not something that he did off on his own.

From my interpretation of what you quoted, that is Manslaughter in the 2nd degree, not murder.

the cops knew GF had no pulse for 2 minutes before attempting any type of life saving measure. This shows disregarded for the danger to GF's life. This was despite his colleagues regard for GF's life as they asked DC to alter his restraint. if DC had been reasonable and listened to his colleagues all this may have been avoided and GF would be alive in jail with no national riots etc.

well that is why he may only earn a manslaughter conviction instead of 2nd degree murder.
