I didn’t say it NEVER happens to men. It is far more likely for an adult female to be raped by men than it is for an adult male to be raped by men.

There is a reason these guys were charged with third degree rape and not a more severe degree.

But maybe, just some should tone it down a wee bit from needing to be right here when arguing to an actual rape victim abkut this? I mean, geez

What exactly are you talking about? I get your overall premise but who is trying their hardest to be right here?

It’s refreshing to hear you say this. Kudos

§43. Third degree rape

A. Third degree rape is a rape committed when the anal, oral, or vaginal sexual intercourse is deemed to be without the lawful consent of a victim because it is committed under any one or more of the following circumstances:

(1) When the victim is incapable of resisting or of understanding the nature of the act by reason of a stupor or abnormal condition of mind produced by an intoxicating agent or any cause and the offender knew or should have known of the victim's incapacity.

(2) When the victim, through unsoundness of mind, is temporarily or permanently incapable of understanding the nature of the act and the offender knew or should have known of the victim's incapacity.

(3) When the victim submits under the belief that the person committing the act is someone known to the victim, other than the offender, and such belief is intentionally induced by any artifice, pretense, or concealment practiced by the offender.

(4) When the offender acts without the consent of the victim.

B. Whoever commits the crime of third degree rape shall be imprisoned at hard labor, without benefit of parole, probation, or suspension of sentence, for not more than twenty-five years.

C. For all purposes, "simple rape" and "third degree rape" mean the offense defined by the provisions of this Section and any reference to the crime of simple rape is the same as a reference to the crime of third degree rape. Any act in violation of the provisions of this Section committed on or after August 1, 2015, shall be referred to as "third degree rape".

Acts 1978, No. 239, §1; Acts 1990, No. 722, §1; Acts 1995, No. 946, §2; Acts 1997, No. 862, §1; Acts 2001, No. 131, §1; Acts 2001, No. 301, §1; Acts 2003, No. 232, §1; Acts 2003, No. 759, §1; Acts 2010, No. 359, §1; Acts 2015, No. 184, §1; Acts 2015, No. 256, §1.

Yes. Third degree rape fits these facts. Not the TN example.

Agreed.

I’m backing away. I agree with elements of what everyone is saying. But there’s no point in arguing for the sake of arguing, especially in a thread that is likely being read by many who knew and loved this beautiful girl. I pray that there is meaningful change and that her death somehow brings goodness…somehow.

Ummm, married. You alleged the victim was accountable because of her drinking. Do you deny that?

I mean do you think this is a little much to say to a rape victim

quote:

Holy fricking shite you women on the OT are bat shite insane. I can see why y’all have no men in your lives and have to come to the OT to get hardlegged and get your daily fix of attention
could you see how maybe she is a little defensive here due to life experiences and telling her she has no men in are lives and she is insane is just a little devoid of decency?

Sure, you might be right in what you are saying, but when you step back and read again what you wrote directly to a rape victim, you don’t feel maybe a little icky?

I said that she shares a small part of the blame, yes. Her decision to let her drinking get out of hand, without some form of contingency plan put her in this position.

Do you deny that???

Come on now! He did say that they're responsible for the majority of the responsibility! Whatever that is supposed to mean.

Lol I'm a nobody from the middle of the nowhere north Louisiana

I have small children and a growing family. Reality is that I don't have the financial backing to make a real run at office but if I could I would do it for $100k and slash and gash the admin cost and increase law enforcement budgets across the board
