They didn’t rob a bank. The argument that “drunk doesn’t absolve you” is irrelevant in this context/situation.
Absolutely relevant as rape charges can be more serious felony than bank robbing. My point here is the consequence can be huge here so everything is relevant.

Agreed, I’m just not convicting these guys merely because someone died.
If they had drunk consensual sex, I think it becomes very blurry and unclear from a legal standpoint. Hence the discussion around this case.

If you have sex with someone incapable of understanding the act, and if you know or should know it, you are a rapist under the law.

My partner was as well?
Arrest us both?
I’m being facetious here, but should we arrest Madison?

I know what you’re saying.
What if both parties are drunk? Who is the “criminal”?

If both are too drunk to understand the act, then neither can be charged with knowledge of the other’s incapacity. Neither is a rapist then.

Go get drunk, rob a bank and tell the judge he can't sentence you to prison, because you were too inebriated to make a proper decision while committing a felony.
you mean, go get drunk, rob a bank with another person, and tell the judge only the other person can be charged with robbing the bank b/c I couldn't consent to robbing the bank with the other person b/c I was drunk.

Exactly.
What you said is my point. If they “raped” her, frick them. Let them rot in prison. But what you said is my point.
I dunno If they raped her or not. But I sure as shite haven’t decided yet without knowing all that is available to know……yet.
The tiny/public info I do know, I’m not convinced of a rape yet merely on the “she was too drunk to consent” argument.
She died, that’s tragic and sucks, but from
What I know publicly so far that has NOTHING (at least criminally) to do with the alleged rape.

I think this is an extremely unlikely scenario in light of the medical phenomenon known as “ethanol penissimus,” aka whiskey dick.

Question on this: Could this lead to character witnesses on Madison Brooks? Like did she have a reputation among those who knew her with having sex with multiple random men she just met? Because how else could they know if she would or wouldn't have consented to having anal sex with 2 men she recently met in the backseat of a car in front of an audience while in her right mind? Or how would they calculate the likelihood of it is what I'm asking?

Question for you, whom i believe to be reasonable/thoughtful poster…
We’ll never know of course, but is it possible they raped Madison and she ALSO raped them (from a legal perspective)?

They apparently had consensual sex
What makes this assumption apparent, Mr. Haley? A slurring, drunk, stumbling, and falling over coed , mumbling something in a highly edited snippet of film that you released in an attempt to blame the victim? And given that rape is a felony, the bank robbery analogy is appropriate.

There's zero evidence they were drunk. They aren't even arguing it, so it's a moot point
Posted on 2/23/23 at 5:47 pm to tonydtigr
She wasn’t slurring at all while apologizing to the driver.
She apologized for calling him a fa**ggt because he wouldn’t participate. and she looked no different than all of us after a night out.

I didn't hear her say that at all.

Stop playing dumb. Are you related to Carter or something? From everything we know:
1. Washington and Carter initiated the sex.
2. They were sober enough to ask for consent multiple times
3. They were sober enough to sexually perform
4. They were sober enough to sexually perform in the dark in a cramped backseat
5. They were sober enough to wait outside while the other took his turn.
No evidence any of the alleged rapists were drunk.

I promise I’m not related and don’t care about any of these people, including Madison.
I think they ALL (including the bar and the laws and the males and Madison) deserve blame.
Unfortunate Chain of events that led to a death. But the question is who to put behind bars.
I don’t have the answer.
