This whole story has become emotional and political because someone died IMO.
If no one died, this would be another night in ColllegeTown USA.

.319 BAC is about 400% above the limit of being able to consent to sex per the Sheriffs Dept.
Video evidence from Reggies of her falling over off her chair and being helped by the idiots to get up.
Statements from the idiots that she was very drunk and was slumped over in the car and could not answer a question.
No matter what is seen on the videos of her talking and walking has no barring when you consider the above.
According to the prosecution there is no grey area when it comes to consent for sex in Louisiana Law when you have a BAC of .319.
The defense attorneys seem to be just making a failing attempt to get a plea deal by submitting these further incriminating videos and the media attention.
Besides the 4 idiots, there may be more charges coming for family members of the idiots for threatening violence on government officials and witnesses.

Those laws were likely written with the intent of stopping men from taking advantage of intoxicated women. Not the other way around. Because in the real world, there is no problem of women going around and trying to find drunk men to have sex with them. And I think you know that.
Women aren't going to bars hoping to find drunk men to have sex with them. On the other hand, men DO go to bars looking for drunk women to have sex with.
Men are typically the pursuers and initiators of sex. That's why gay men have the most sex and lesbians have the least sex. According to statistics. Straight men don't have as much sex as gay men because the woman is the one who puts the brakes on it.
Even in this case, it was the men who initiated the sex. It wasn't Madison. They saw she was drunk and saw an opportunity to get laid. If they were pissy drunk and she was sober, do you think sex would have took place? It's highly unlikely that a relatively sober Madison would have gotten an obviously intoxicated Kaivon and Desmond in the back seat of a car and initiated sex with both of them one after the other.

Sex won’t come in under 412 but I’ve thought reputation regarding drinking and past instances of binge drinking may come in given the BAC compared to the cogency in the videos that have been made public.

It’s extremely implausible. It MAY technically be possible.
For those who don’t know, Cheney taught criminal law and was known as the “Smiling Executioner.” In law school, you have one exam per class. It is a four hour essay exam. Cheney’s were somewhat hard. This was back in the day when half your class flunked out.
